Joe Biden on Monday told doctors and hospitals around the country that they must perform abortions in emergency situations if the mother’s life is in danger even if their state has a ban on the procedure following the Supreme Court’s decision to overturn Roe v Wade.
The Supreme Court overturned Roe v Wade last month which means states decide their own abortion laws.
More than 25 states have ‘trigger bans’ – meaning abortion becomes illegal or severely restricted once Roe v Wade is overturned.
Biden threatened to issue fines and strip Medicare status from hospitals that fail to perform abortions in emergency situations.
"Today, in no uncertain terms, we are reinforcing that we expect providers to continue offering these services, and that federal law preempts state abortion bans when needed for emergency care,” said Health and Human Services Secretary Xavier Becerra. “Under the law, no matter where you live, women have the right to emergency care — including abortion care.”

This is just grandstanding. No one would withhold an abortion if it’s really an emergency situation for the mother.

I thought Biden said it’s wrong to withhold medical care from people, forcing them to travel to another state to get help.
I’d like SCOTUS to take up whether CMS can blackmail hospitals whenever things aren’t going to administration’s liking...like I posted earlier, vax mandates as well as “emergency” abortion—who knows what other issues they have used withholding of funds to get their way.

Sounds like BS like the 10 y.o. rape victim that had to travel out of state to get an abortion. I can’t imagine a situation that required an “emergency abortion” that wouldn’t be covered under existing law.

Exactly correct. Claiming the opposite is a lie just to whip up more hate and division. There is a big difference between saving the life of the mother and saving the HEALTH of the mother. The latter could be the stress brought on by the pregnancy.

A woman is in danger…does the doctor perform an emergency C section or an abortion?
And you would be wrong like most mush heads who couldn’t read a legal brief to save their lives.
How about you read up on the Emergency Medical Treatment and Active Labor Act (EMTALA) then get back to the class on how life saving procedures are not explicitly mandated in that act to include terminations should the life of the mother be in danger. I’ll wager a months pay you fail to construct a legitimate legal argument let alone find precedence in case law to refute exactly what the Federal government just reminded the hospitals they are bound by Federal law to do with the full weight of the Federal supremacy clause firmly in the gov side here.
