NEW YORK (CNNMoney.com) -- More than half of all homeowners with modified mortgages fell at least two months behind in their payments a year after the adjustment was made, according to a federal report released Wednesday. However, the data also shows that modifications made in 2009, which emphasized reduced monthly payments, may perform better. Only 40.7% of loans modified in the second quarter last year were delinquent after nine months, compared to 51.6% of those adjusted at the end of 2008, according to the report, published by the Office of Thrift Supervision and Comptroller of the Currency.

I am curious to know if there is a legal requirement when someone applies for a loan modification that the financial institution must provide its decision in writing. If there is, and no such document exists, and you are told verbally of a decision, is there legal recourse?

The Obama administration's first progress report on its foreclosure prevention plan confirms it is off to a slow start. Just 9% of delinquent borrowers in trial modifications so far, the Treasury Department said Tuesday. That translates into 235,247 loans that were at least two months delinquent. Under fire for the program's rocky start, the Obama administration says it is on pace to help up to four million homeowners over the next three years. The initiative was announced in February and the first institutions to join began accepting applications in April.
