In his own words, he said that those things were not within the proper definition of "religion." Do you agree or disagree?

They are not within the definition of the word "religion" as modified by the word "establishment".

I'm not sure what point you're trying to make. If you're trying to suggest that he's out to trample on the rights of non-Judeo-Christians, I'd be interested in seeing how. It would be rather out of character for him, since he'd be violating the word of God, as he understands it, if he were to do so.

No, but I wouldn't live in the slums of poorer South American countries either, and they're overwhelmingly Christian.

And who appointed you the person to decide which religions are legitimate? I imagine Hindus think Christians are misguided in some of their beliefs.

And what exactly do living conditions have to do with the validity of a religion? Look at the living conditions in some of the heavily Catholic South American countries. Would you want to live there? BTW, while you do find horrible grinding poverty in India, you also find fabulous wealth and very modern living conditions.

Okay - is the right given to Hindus and Buddhist by the Judeo-Christian God to practice their faith protected by the 1st Amendment of the U.S. Constitution? Judge Moore's own words indicate that he does not believe it is.

Not judging from the words you posted. He wasn't talking about the free-exercise clause.

and what pray tell do you know of Judge Moore's character? Ever met the man? been in his court? Or are you such a keen judge of a man that you can spot a good'un just by watching Hannity and Colmes? Tell me o wise one? You know Judge Moore is such a good man, what makes him so good?

Let's try to address the real issue - hopefully in a civil debate - and maybe we can get somewhere without eating bandwidth on things that aren't in dispute.

First - I agree that prior to the passage of the 14th, the 1st did not apply to the states.

Second - I don't disagree with the fact that worship services have been held in government facilities, nor do I condemn such action.

Third - As you well know, the question of Incorporation is not an easy or one-sided question. There is much evidence on both sides of the issue. The Court didn't make it up out of thin air. I have posted to you quotes from the debate on the 14th indicating that incorporation was the intent. You have posted information on the Blaine amendment which - if taken a certain way - could indicate that incorporation happen with the 14th. I have posted historical information on the intent behind the Blaine Amendment - which was specifically intended to maintain, not eliminate, informal Protestant establishment in the states.

Fourth - one point of disagreement that lingers, from a factual standpoint, is your contention that the courts rejected incorporation prior to Gitlow. The only case you have cited from 1867 to 1925 is Davis v. Beason. Davis v. Beason DOES NOT say that the 1st Amendment does not apply to the states. I am not aware of any case in that time period that does. If you are, I'd love to see it.

I have no chip. I would defend Catholics (and have done so) if my Prod bretheren are dumping on them.

BTW...I am not terribly pious frankly. This is all part of an overall cultural struggle for me.

The fact that the ACLU and Dees and that pseudo religious group the AU all are what composites the enemy ranks gives me great pride.
