If Davis resigns, then he de facto is no longer the office holder. Could he then run as a candidate on the second part of the ballot?

How about this. He resigns -- and then pony's up the dough to qualify as a name on the recall ballot.
He's always been much better at campaigning than governing...
I think that might even be within the rules. 1. It spikes the Lt. Governor who can't really campaign because he now has a state to run and it frees him from duties and let's him go into full campaign attack mode.

that gets me thinking ... Bustamonte is running thereby stabbing Davis in the back. Davis returns the favor and resigns. Bustamante becomes acting governor until Arnold wins the recall. He becomes Governor and Bustamante is out of a job! We could get two recalled for the price of one!

Clinton is calling the shots here, WWCD (What Would Clinton Do) How would he play this ???? Clinton would have a Democratic operative release a "secret" videotape of Clinton giving Gray Davis a "Lewinsky."
James Carville, Paul Begala, Terry McAuliffe, et. al. would then hit the airwaves, claiming that the recall effort is "just about sex."
Sounds like a plan to me.
