A Fremont resident who fought with armed home invaders on Friday grabbed a suspect’s firearm and used it to fatally shoot the burglar, according to police.
Officers responded to the shooting around 12:12 p.m. at an apartment on San Pedro Drive. Fremont Police Department investigators said two teenagers forced their way into the home and assaulted two residents.
“During a struggle, one occupant gained control of the suspect’s firearm and fired it towards them, fatally wounding one of the suspects,” Fremont PD wrote. The suspect who was shot succumbed to his injuries at a local trauma center.
Suspect at large in deadly El Cerrito shooting The second suspect attempted to flee the area but was located and arrested, authorities said. He was booked into the Juvenile Justice Center for residential burglary and felony assault with a semiautomatic firearm.
The two residents suffered non-life-threatening injuries in the attack, according to police.

So, for the thirty seconds the resident held and fired the gun, California cops with charge him with illegal, unlicensed possession.

Back in my hunting days, I did not ‘fire my 12 ga. towards’ pheasant; I simply ‘shot’ them.
I guess the PD is trying to stay neutral about why someone whose apartment was being invaded by armed attackers would want to ‘fire a weapon towards’ one of them, but I cannot really understand why... (Yes, feeling persnickety this morning...)

The incident happened in Fremont - a South Bay city near San Jose. The el Cerrito was a reference to a different story.
The homeowner took the gun from the perp. Subsequently there was no threat to the homeowner and he couldn’t possibly have been in fear for his life. Second degree murder with extreme prejudice.

He will be charged with manslaughter. The need to kill was removed after the teen was disarmed. At that point there was no more threat.
