A federal judge on Friday temporarily halted deportations of eight immigrants to war-torn South Sudan the day after the Supreme Court greenlighted their removal, saying new claims by the immigrants’ lawyers deserved a hearing.
District Judge Randolph Moss proceeded with the extraordinary Fourth of July hearing on Friday afternoon, directing the Trump administration to discuss whether a prior Supreme Court ruling that immigrants slated for removal under an 18th century wartime act invoked by President Donald Trump deserve due process might also apply to those due to be removed to South Sudan.
The administration has been trying to deport the immigrants for weeks. None are from South Sudan, which is enmeshed in civil war and where the U.S government advises no one should travel before making their own funeral arrangements. The government flew them to Djibouti but couldn’t move them further because a Massachusetts court had ruled no immigrant could be sent to a new country without a chance to have a court hearing.
The Supreme Court vacated that decision last month, then Thursday night issued a new order clarifying that that meant the immigrants could be moved to South Sudan. Lawyers for the immigrants, who hail from Laos, Mexico, Myanmar, Vietnam and other countries, filed an emergency request to halt their removal later that night.

if I were the Trump administration I’d respond that the SCOTUS put a halt to this judge putting a halt to their deportation and I’d have deported them. Screw you judge. You had your turn and were overruled. If you don’t like that, try enforcing your decision yourself.

I don't. If you paid me a million dollars to say something positive about Sotomayor or KBJ, I couldn't do it. Both of them are idiots and have no business being on the Supreme Court. Stupid partisan hacks, the both of them. That is not Kagan. She leans left and is too much of a "living Constitution" proponent for my taste, But she is far from stupid. She can generally be counted upon to make the best, most intelligent argument available in opposition to a more textualist/originalist approach. That doesn't make her right, but it does make her intelligent and honest.

FWIW, I would have posted the same thing as you, that this was a last-ditch effort by activists to stop the deportation with a new, nuanced argument that hadn't been heard before -- specifically that the deportations were "punative" in nature against these individuals. The court ruled that they were not punative and dismissed the argument.

The Trump Administration can now deport aliens to third countries. I guess Murphy really did not want SCOTUS to issue a writ of Mandamus.
The problem actually is more significant than that, because an intelligent lay person who actually reads the things upon which they comment would be better off than those Freepers who react only to headlines without bothering to read what's inside.
Which happens far more often than it should.
These dirtbags will soon be in South Sudan, where I am sure they will enjoy the hospitable climate and friendly natives. LOL
When the Russkis invaded the Ukraine, why weren’t they given “due process”. The Ukrainians just started wasting them.

I’m sure it is tempting but the narrative that the media would present would be terrible. “Disobeying a federal court order! Constitutional Crisis!” That’s what the left wants.
So far Trump is winning in higher courts and especially at SCOTUS.
