18- to 20-year-olds can’t be barred from buying handguns, judge rules

A federal judge in Virginia on Wednesday declared unconstitutional a set of federal laws and regulations that prohibit federally licensed firearms dealers from selling handguns to 18- to 20-year olds, finding the measures violated the Second Amendment.

“Because the statutes and regulations in question are not consistent with our Nation’s history and tradition, they, therefore, cannot stand,” U.S. District Judge Robert E. Payne, who sits in Richmond, concluded in a 71-page opinion.

Attorneys on both sides of the case said they expected the Justice Department to appeal the decision and request a stay, which would prevent Payne’s ruling from taking immediate effect while higher courts weigh the case.

Although 18- to 20-year-olds previously could buy handguns in private sales — or have a parent purchase a weapon for them — the decision Wednesday, if left unchallenged, would dismantle a legal framework that for decades has prevented licensed dealers from selling handguns “to teenagers,” said William T. Clark, an attorney with the Giffords Law Center, which filed an amicus brief in the case calling for the laws at issue to be upheld.

Pre-teens bought guns when I was a kid. Maybe at Woolworths and similar, IIRC. No crazed kids doing shoot-’em-ups — ever.

Better parenting. Churches were primary in families’ lives.

This needs to apply nationwide. There’s nothing in the constitution that restricts the rights of an 18 year old. I still remember joining the Navy at 19 and arriving in California to find my right to drink beer was restricted off base because the laws were changing to 21.

Because it is a stupid premise. Nowhere does a 3 y/old go to a store to laydown 10’s of dollars for a gun.

Really? Where did you come up with that idea? I graduated from UCSD at age 19 and have been full time employed every day since that time. Still working 55 to 80 hours a week as a software engineer performing work for US government agencies. Turning 67 this year.

I would point out that raising the age of majority from 18 to 21 (and they’re pushing for further now) hasn’t done us much good. The stupid people now find it harder to get themselves killed off early and now live longer - long enough to start messing up society.

Perhaps it would be better to engage social darwinism instead.

I’m not going to agree with the other party entirely here, but it’s not entirely baseless. For example, statistically the single largest and fastest growing group for STDs per capita at current is Baby Boomers. The top three zip codes for new HIV infections in the US are Boomer retirement communities in Florida.

It may not be true for individual Boomers, but there’s evidence that he’s got a point for Boomers as a general group.

Because there is no constitutional amendment on “the right of the people to buy intoxicants shall not be infringed”.

Also, Section 2 of the 21st Amendment, which rescinded prohibition, expressly gave broad powers to the states to regulate alcohol.

Either set the age of majority to 21 and enforce it or leave it at 18 and open it up.

I vote that we increase the minimum age for drinking, smoking, driving a car and voting to 21 (30 would be even better).

I bought ammo when I was in elementary school. I bought a rifle when I was 15. In high school, we used to bring our hunting rifles to school during deer season and compare them in the parking lot before we left to go hunting in the afternoon.

OTOH, I am kind of old.

The legal age for enlistment would also need to be raised to 21, in that case. We would also have more stupid youngsters surviving to become stupid adults and voting stupidly.

Make it a 13 year old then, plenty of 13 year olds would love to own a gun and plenty of them would have enough Christmas and birthday money saved up to afford one. So, can a 13 year old walk into a store and purchase a firearm?

And if you won’t answer that, then we know you have another reason you don’t want to admit for not giving the blatantly obvious answer to such a simple question.
