18- to 20-year-olds can’t be barred from buying handguns, judge rules

A federal judge in Virginia on Wednesday declared unconstitutional a set of federal laws and regulations that prohibit federally licensed firearms dealers from selling handguns to 18- to 20-year olds, finding the measures violated the Second Amendment.

“Because the statutes and regulations in question are not consistent with our Nation’s history and tradition, they, therefore, cannot stand,” U.S. District Judge Robert E. Payne, who sits in Richmond, concluded in a 71-page opinion.

Attorneys on both sides of the case said they expected the Justice Department to appeal the decision and request a stay, which would prevent Payne’s ruling from taking immediate effect while higher courts weigh the case.

Although 18- to 20-year-olds previously could buy handguns in private sales — or have a parent purchase a weapon for them — the decision Wednesday, if left unchallenged, would dismantle a legal framework that for decades has prevented licensed dealers from selling handguns “to teenagers,” said William T. Clark, an attorney with the Giffords Law Center, which filed an amicus brief in the case calling for the laws at issue to be upheld.

Whether a 3 year old can or cannot do that is besides whether the 2nd amendment is somehow a right of passage. It is not. And it has nothing to do with alcohol use.

The media was spiking the ball about a bill in a TX legislature committee that would have restricted that same age range, which ultimately would have met the same fate as the one in Virginia. It was DOA since they missed the filing deadline, which the mediots didn't admit until yesterday.

You’d have a point except for the fact that it is now ridiculously expensive for young people just starting out - even in ‘low cost of living’ states and area. Friend of mine had his daughter turn 18 and despite having a decent paying albeit entry level job in a low COL area she literally cannot afford her own place or her own health insurance.

That is my POINT

Change the age of adult rights to 25.

For the healthcare, I hesitate to believe that. There are cheap plans out there. I know because I have people in my sphere on them. Not good plans, but satisfy the law.

May not be offered by her employer though, which is an interesting scam.

Either set the age of majority to 21 and enforce it or leave it at 18 and open it up. What we have now is a sick farce.

I agree. Logic and reason have very little to do with the law though.

Has absolutely nothing to do with a rite of passage.

I don’t see a problem with an adult caregiver parent or guardian storing in trust a firearm that a 3 year old may legally own or had ownership transferred to them.

But this has absolutely nothing to do with alcohol use, or rites of passage.

The age of majority should apply to all citizens and for all activities - buying guns, signing contracts, opening bank accounts, voting, etc.

Time to repost the 1846 ruling from the Georgia State Supreme Court on hand gun bans...I believe they got it right.

* Nunn v. State, 1 Ga. (1 Kel.) 243, at 251 (1846).

“’The right of the people to bear arms shall not be infringed.’ The right of the whole people, old and young, men, women and boys, and not militia only, to keep and bear arms of every description, and not such merely as are used by the militia, shall not be infringed, curtailed, or broken in upon, in the smallest degree; and all this for the important end to be attained: the rearing up and qualifying a well-regulated militia, so vitally necessary to the security of a free State.”

Her employer is a small business that does not have to offer it due to the small personnel size. Her premiums on her own would be over $1250/mo, I have been told.

As a young (thirteen ish) lad, I owned a few firearms (this was in the 60s). I was completely trained and quite careful. I loved being trusted and I acted responsibly in return.

At 18 yrs (and one week), I was uniform. More trust and more responsibility.

Drinking? Not a major issue with me, although it was available in most of my duty stations for 18+.

Looking back, being trusted and having important responsiblities at an early age helped to shaped my adult behavior and life choices to a major degree.

If they can change their gender, why not. It seems logical if they are smart enough to Know they are not the same gender as their genetic makeup then, they are smart enough to smoke and drink.

He just can’t smoke, get a tattoo, or buy booze.
