‘Federal Assault Weapons Licensing Act’ Introduced

This week, Congressman Chris Jacobs (R-NY) introduced the “Federal Assault Weapons Licensing Act,” a bill that would establish a licensing system for prospective purchasers of modern sporting rifles (MSR).

Per the legislation, one would need to take a mandatory safety course, pass an FBI background check, submit fingerprints and provide proof of identity as part of the licensing process.

The license would need to be renewed every five years.

Anyone who already owns an MSR would be grandfathered in, however, if they wanted to buy an additional MSR they would need a license.

“My legislation is common sense and provides a straightforward licensing process to ensure those who are purchasing and taking ownership of assault weapons are responsible, law-abiding Americans,” Jacobs said in a press release obtained by GunsAmerica.

I really wish our Constitution included a provision for a small, focused government body that would look at proposed legislation and just say: “Stop! Go no further! This is a waste of time, it’s unconstitutional on it’s face, and you can’t do that.”

That would kill all gun control at all levels of government.

It would also end any consideration of federal laws on abortion. The 10th amendment would still allow action on something like abortion at the state level. But gun control is special and it’s an infringement and no one is allowed.

So much of what the federal government does today is unconstitutional, but there is no one to stop them.

That’s because every time they try to go against handguns there’s a huge backlash from people who don’t care about rifles but believe they need pistols to protect themselves - which includes a not-insignificant part of the Democrat party itself. They learned from GCA68 and AWB94, both of which had pistol restrictions and both of which had electoral consequences. NY SAFE was their most recent attempt and it didn’t go well even in a place that hates all guns.

Actually, the DemocRats have been going after handguns for a very long time. The 1934 NFA initially targeted handguns, but the leadership caved on that because the majority wouldn’t support it. And the 1968 GCA specifically targeted cheap imported handguns (Saturday Night Specials) and banned them. And every major anti-gun bill has at least initially had handgun bans or restrictions in them. Including the 1994 AWB that banned “high capacity” magazines for pistols as well as rifles.

Yes. That is classic “who watches the watchmen?”

The legislature cannot be trusted to police the legislature. If they feel like acting unconstitutionally, they just will. It becomes part of the horse-trading.

You forget his voters are New Yorkers. The majority of New Yorkers hate and fear guns, gun owners, anyone who lives in “fly over country”, and the second amendment with an irrational fanatic passion that goes beyond obsession and borders on psychosis. The odious Carolyn McCarthy was a single issue rep - hard core anti-gun. It got her elected and re-elected for years

Jacobs needs to be kicked out of the Republican caucus and party. The GOP is a big tent, but it’s not a circus tent. No freaks allowed. No gun grabbers. No transgenders. No TDS.

In a way I hope they pursue this because it will likely get before SCOTUS faster than any efforts to fight the 1934 NFA and gun control act of 1968. This may make the whole process for fully autos and suppressors come under scrutiny.
