I think Roberts attempt to “help” the plaintiff was telling though.

I think he’s trying to look impartial.

But I don’t know. I don’t trust him for sure.

Breyer minimizes 3% of the workforce quitting. Says, “So what?” Then why are you (Breyer) worried about 0.01% even getting this virus to begin with?

The emergency rule by OSH has a 6 month life.

After that, the “regular” regulation will come into play, and be litigated starting from District Courts.

Unless SCOTUS rules that OOSHA has the power, in which case litigation is pointless, issue already decided.

Sotomayor says Omicron is as deadly as Delta. OMG, give OHSA more power. And what fed agency is in charge of masking in public?

A lot of folks may not understand the legal nuance here. This isn't about "individual liberty" at all. OSHA regulations and the burden of enforcement apply to employers, not the employees.

A lot of "individual liberty" goes out the window once you work for someone else. You've already surrendered much of your freedom to the employer, and now we're learning how much autonomy and power the employer has surrendered to OSHA.

One of the things I talked about when this first hit was that OSHA, the EPA, FDA, etc. exist outside of the legal framework.

They pass regulations without a law. Enforce it, and do everything without much recourse to elected officials.

Congress as currently constituted wouldn't touch it. In fact, this case could give Feds much more power, in which Congress will be overjoyed.
