The ETS on Vaccination and Testing was officially filed in the Office of the Federal Register on November 4, 2021. Find information on the COVID-19 Healthcare ETS or on Coronavirus Disease (COVID-19).

Exactly. Don’t we have supposedly, something like 75% of the country vaccinated? Notice hope they never give any indication of what the magic criteria is for this to go away. It is all about control

One interesting point - Independent Contractors are not subject to the RTS. I would expect that there will be a move to transition some employees to independent contractors.

Now you know why the commie dems are so hot to pass laws that make gig workers be considered as FTEs.

Probably none because it isn't officially published until tomorrow. This is the first lawyers have seen the actual language, so it will take some time to tailor the motions and briefs - which are largely already written - to the exact language.

Monday should be a hoot, though.

2.A.2. Is the count based on 100 employees for the entire business or 100 employees per individual location?

The count should be done at the employer level (firm- or corporate-wide), not the individual location level.

So, if I work at a small place with around 20 employees, because it is part of a larger company that has over 100 employees at different locations, the mandate still stands, right? This is downright harassment. The regime has decided to use the stick.

OSHA has initiated a 30-day public comment period and is inviting comments on any aspect of this ETS and whether the ETS should become a final rule. The public comments will allow OSHA to gather information, diverse perspectives, and technical expertise to help the agency in considering next steps. Wow - 490 pages.

That is why I believe some companies will forgo the testing option. Of course, if someone applying for an exemption has it granted, they still have to (in most cases) weekly testing. But they would be a much smaller subset of employees submitting test results.
