Statement of Justice Alito, with whom Justice Thomas joins: In my view, we do not have discretion to deny the filing of a bill of complaint in a case that falls within our original jurisdiction. See Arizona v. California, 589 U. S. ___ (Feb. 24, 2020) (Thomas, J., dissenting). I would therefore grant the motion to file the bill of complaint but would not grant other relief, and I express no view on any other issue.
Texas is getting all those California folks with their California ideas.
We saw that in VT with the influx of New Yorkers and CT folk who thought VT was Ben and Jerry’s and Bob Newhart.
They have pretty much ruined the place.
I never considered Obama to be a legitimate president, either - but the media sure did. Politics is crooked around the globe; Biden and Harris will be treated as legitimate by foreign governments, and that is all they need. Nope, this is far from hollow.
The only open path to fix this is the old and bloody one.
They won’t arrest him. He hasn’t broken any laws and they have no case against him for anything. He’ll have Secret Service protection even after he leaves office and nobody will want to mess with those guys. All that stuff about tax violations in New York is all fabricated political attacks with no substance. His family has had top tax lawyers for decades and I’m sure their tax filings are completely within the law.
I don’t think that is going to happen.
This is the WORST time for FReepers to be going for each other’s throats.
But I understand.
Everyone is VERY frustrated. And angry, rightfully so.

Pretty much exactly what I thought would happen, including the statement by Alito, although the wording is interesting. Does he mean he thinks there is standing, or does he just mean they should grant leave for the complaint to be filed and that jurisdiction can be determined after that, as it is in normal lawsuits?
Alito and Thomas have pointed out several times in recent years that the Supreme Court’s practice of treating original proceedings as discretionary is unconstitutional, because the Anglo-American tradition is that courts must hear cases that fall within their original jurisdiction.
