Officials of President Trump's transition team plan to ask Special Counsel Robert Mueller to return "many tens of thousands" of transition emails they contend were unlawfully provided to him. But the prosecutor's office says emails being used in the investigation were properly obtained.
What's new: A source close to Trump's transition, which still exists as a legal entity so it can shut down what was once a 1,000-person operation, said the transition will send a letter to Mueller informing him that some of the emails are privileged, and asking for their return. The transition says it is willing to provide Mueller with vetted emails.
[snip] What's at stake: We're told that the fight involves emails from the accounts of 12 officials, including members of the political leadership and foreign-policy team. One of the accounts alone includes 7,000 emails.
Trump officials discovered Mueller had the emails when his prosecutors used them as the basis for questions to witnesses, the sources said.

Hilary’s emails were not in the government sanctioned system. Hence they could not be seized. This of course is a criminal action but she dodged it with help from the Obama DOJ.
What they were able to get were emails that were also CC’d to others on the government system.

Getting Mueller on a process crime would be SO fitting.
Rosenweasel will see no intent and brush it off as Trump’s fault.
Trump is in a position to order the FBI to seize all copies and return them to rightful ownership.
Trumps lawyers need to do a deep dive on all of Mueller’s hard drives to wipe the e-mails and all references to them.

The Democrats are probably checking and changing the emails for the next attack on Trump
This is a opposition data mining operation to be used in the next election. Mueller is an American traitor.
You are missing this. This is the Trump campaign making legal groundwork that Mueller is in possession of emails he has no right to possess.
How do you “return” emails. Both groups now have copies and always will.
I beg to differ. All of hilliarys emails are on an NSA server.
The only legal way that Mueller could have obtained them is by formally requesting access or copies from the Trump Administraion. The White House lawyers would then review the email archive to scan for responsive documents and then vet the documents for privileged communications
Obtaining privileged Presidential transition documents the way it was done is an explicit clandestine end run around proper constitutional executive privileges and also constitutional separation of powers.
The Mueller investigators handling these documents are partisan hacks who do not have proper security clearances to view the documents and a number of these emails have already been illegally leaked to the media by said partisan hacks.
It's a 100% certainty that they have been given to Democrat opposition research operatives.
What Mueller has done is illegal and unethical as hell.
You can get a subpoena for responsive documents from an email archive, but you can't just obtain a data dump of Presidential transition documents that contain informationtnah covered by Executive privilege and Attorney-Client privilege

So Mueller’s “ we got them thought a legal process” was really, “We asked someone at the GSA and they gave them to us”.
Mueller can’t return them, but they are in effect tainted evidence.
Any other findings that his investigation has made on the basis of these emails can be thrown out.
It has been reported that some Trump campaign officials were asked questions that could only have been derived through access to these emails, which appear to have been given to Mueller’s team illegally.

Return the emails after making copies of them? Come on, get balls and fire Mueller and his entire team for illegally obtaining the emails. This is a gift on silver platter for a readymade excuse to fire Mueller’s azz.
