The top U.S. nuclear commander said Saturday he would push back against President Trump if he ordered a nuclear launch the general believed to be "illegal," saying he would hope to find another solution.

Well, I only spent 25 years in. On two occasions, I told my commander to run his order past legal. And if they said it was legal, I’d obey. Both times my CO backed down, although he was pissed and took revenge later.
On a third occasion, I was told I’d be given an Article 15 if I didn’t comply. I said I preferred a court martial. That commander backed down, too. There weren’t any consequences to me that time since HIS commander heard about it, and my CO had “consequences”.
There are people who will give illegal orders. You need to know what you are doing if you refuse, and yes, there can be consequences that have nothing to do with the UCMJ if you refuse. But I had no regrets.

The Commander in Chief determines the legality of his orders before he issues them. That is why he is the Commander in Chief, and not the U.N. or some snowflake General or activist judge, thank God! : )

The way it makes sense to me is:
If the CIC gives them an order, they MUST either follow it, or, if the general determines for himself that it is somehow “illegal”, then the general would need to resign.
In short, obey orders or resign.
IMO, anyway.

It has to be an illegal order to justify disobedience. Now who is to say what’s an illegal order? That’s a judgment call and made at ones own peril. Nuremberg trials ended “I was only following orders” as a defense against criminality.
So if you were the general last year, and Pres Obama called up and told you to nuke Texas, you would salute and hit the button? How about just Tel Aviv?
There are protocols in place to cover the initiation of a nuclear first strike. Now, a nuclear RESPONSE to an incoming attack would necessarily be a different story.

Hyten was responding to a question about testimony by former STRATCOM commander retired Gen. Robert Kehler before the Senate Foreign Relations Committee earlier this week. Kehler said that nuclear operators would refuse to implement an unlawful order. Hyten agreed, and argued that the process in place to launch a nuclear strike would prevent such a situation from arising in the first place.
The soon to be relieved general advocates arguing with the commander-in-chief, not simply clarifying an “illegal” order. This officer is not fit for command unless he was misquoted.

The “Trump might issue an illegal order” smear has been a long standing attack against POTUS. The General knew that and yet still played ball with the Trump haters at the security conference. Unforgivable, in my book.
Remove him IMMEDIATELY; with his own mouth he has confirmed that he will refuse to uphold the military oath he took when he was sworn into the military.
“I think some people think we’re stupid,” Hyten said in response to a question about such a scenario. “We’re not stupid people. We think about these things a lot. When you have this responsibility, how do you not think about it?”
It’s amazing how many sheep just mindlessly follow the propaganda CBS and other MSM outlets spew out.
