Will Kelo Decision Finally Sink Donald Trump?

Donald Trump’s high standing in the polls is attributable entirely to the fact that he’s not a Washington insider, not part of the racket, and despite his wealth really might actually give a damn about the Little Guy. So why is he saying things like this?

Donald Trump on Wednesday defended government property seizures as a “necessary thing,” even when it means involuntarily taking property from a private owner to transfer it to another business. Trump was speaking to reporters outside the capital statehouse moments before formally filing his candidacy for the February primary, and the Washington Examiner pressed him on his record of using eminent domain laws to expand his casino empire.

“Property rights are a big issue in New Hampshire,” the Examiner noted. “In Atlantic City you used eminent domain laws aggressively to expand your casino.”

Trump interjected by calling this a “stupid question” before launching into a defense of eminent domain. ”I am all for private property rights,” Trump said. “There’s nobody who wants property taken away less than I do, believe me. I would lose a lot of money if my property were taken away. But when you’re building a road, when you’re building a highway, when you’re building whatever it is you’re building from a municipal standpoint, you may need a corner of a piece of property.” As he said this, he pinched his fingers together to demonstrate the smallness of the property.

The abstract reasoning may be sound — although in the Supreme Court’s disgraceful Kelo decision it certainly was not — but the optics are terrible. It smacks of Romneyism, a cluelessness about how ordinary people live their lives.

Folks here at FR seem to prefer a populist Nationalist like Trump.

Fixed.

The battle is not libral vs conservative, it is nationalist vs gloBULList. The Establishment Republicans are all gloBULList to one extent or another. Very status quo establishment, even Cruz.

I’m not sure that as president he can do much about eminent domain one way or the other.

If Trump is serious about building a border wall, he will have to use massive amounts of eminent domain, because much of the land along the border is privately owned. Every one of those landowners will be entitled under federal law to a jury trial on the issue of just compensation, which means the process will necessarily take decades and cost untold millions.

We, the American Citizen, are just in the way for power people.

This is funny. Everything Trump built was for people. Hotels, are for people. Casinos are for people entertainment as well as profit. May not be you, but without them travel might be useless.

Most of all the eminent domain was used to create roads, pipe lines, etc. Occasionally it is used wrong, but very seldom. If a huge shopping complex is held up for a piece of property, the owner is offered way more than the property is worth. Is this wrong to provide service the community needs?

This kills me. It’s the law of the land. Firstly, second he gives a reasonable explanation. Not like other politicians who will talk a big talk.

This guy, if he stays healthy, is the best thing for this country. We should have had Reagan when he ran against Ford. I pray the same thing doesn’t happen this time.

I see Bush dropping out, then the rest, leaving Cruz, Rubio Fiorina and Trump.

As well, the increase in H1-Bs to 325,000 was an offer in compromise for REDUCING overall legal immigration, by cutting back unskilled labor by 500,000, resulting in an overall reduction in LEGAL immigration by 240,000. This proposal STOPPED the open borders GANG OF EIGHT bill.

I have no morbid attachment to my material possessions including the house. It is just bricks, mortar, wood and plastic. It is what is inside the house which matters, such as pictures, clothes, even my favorite chair. If they compensate me over and above current market value of house, I would sell in a NY minute. It is always interesting to move into a newer and better house for me.

Trump had nothing to do with Kelo which turned into a disaster. He offered 2 million dollars to the woman in AC. What other developer would do that? I was involved in eminent domain fights at the Jersey Shore in the early 2000s and they were offering PEANUTS (to use a Trumpism) to the poor folks who were losing their beachfront houses. Once the developers had secured that land, it would accelerate in value beyond belief. Happily, in one case, we fought them off. There are many really bad developers. I don’t believe Trump is one of them.

This is a tacit recognition of a preexisting power to take private property for public use,

No it's not...Not in my opinion. To think this runs contrary to private property rights.

To approve of this, you have to contort yourself into the uncomfortable position of claiming that Government actually owns/controls completely all private property under it's jurisdiction and that these private owners really only have secondary ownership rights.
