An Army official reveals the tough charges the military has planned for POW, Bowe Bergdahl.
Sgt. Bowe Bergdahl, who was released by the Taliban last year in exchange for five prisoners, is being charged with desertion, retired Lt. Col. Tony Schaffer told Bill OReilly on The OReilly Factor Monday.
Mr. Shaffer, who now works for the London Center for Policy Research, said two separate military sources have confirmed to him that Sgt. Bergdahls attorney has been given a charge sheet, listing out the articles of the uniform military code that have been violated.

I saw this interview and my conclusion was that the administration was still trying to cover itself. Or did I mishear the conversation?
Obama will say..so what...he was still a prisoner of war...and any punishment is "time served".
All anyone has to see is Obama's touchy, feely picture with Bergdahl's momma to know the "predestined" outcome.

All I know is this... nothing else. Knowing the circumstances, I don’t think you will find ANY not ONE active or inactive soldier or sailor who would say that Bergdahl DID NOT desert. They will ALL say that he deserted.
If for some reason this comes out that he will not be charged for desertion, then something is really wrong here. I think Bergdahl knows the truth and probably admitted as such and willing to accept the consequences. Why? Because he’s damn lucky to still be alive. Damn lucky.
So we exchanged 5 prisoners for 1 deserter?

Maximum punishment (for desertion)
(1) Completed or attempted desertion with intent to avoid hazardous duty or to shirk important service. Dishonorable discharge, forfeiture of all pay and allowances, and confinement for 5 years.
(2) Other cases of completed or attempted desertion.
(a) Terminated by apprehension. Dishonorable discharge, forfeiture of all pay and allowances, and confinement for 3 years.
(b) Terminated otherwise. Dishonorable discharge, forfeiture of all pay and allowances, and confinement for 2 years.
(3) In time of war. Death or such other punishment as a court-martial may direct.
I smell a pardon on the way.
IF he is charged that is one thing...
It’s another to actually convict...
And another to actually impose and carry out any sentence worthy of a deserter.
I’ll wait and see, but I’m extremely cynical.
