John Kerry Praises New UN Gun Treaty – Could Lead to National Registry

Secretary of State John Kerry welcomed the opening of Arms Trade Treaty for signature today.
The Obama administration plans on signing the treaty as soon as the process of conforming the official translations is completed satisfactorily.
The United Nations passed sweeping legislation in April that will regulate the international arms trade and could lead to a national gun registry in the United States.

In March the pro-Second Amendment Senate Bill 139 passed 53-46. 46 Democratic Senators voted against the bill which would: Uphold Second Amendment rights and prevent the United States from entering into the United Nations Arms Trade Treaty.

It has no force of law without the Senate ratifying it and no matter what anyone says... that is the truth. I do not think that they have nearly enough votes to pass it in the Senate.

Even if ratified, the notion that a treaty overrides the Constitution is just plain untrue.
2A is unaffected by a treaty.

They don't. It's just like how Clinton signed the Kyoto global warming treaty but the Senate went on to reject it 98-0. Budda's signature was meaningless.

It's my understanding that President's in the past have said they would abide by the terms of treaties that have been signed and not ratified. However, this is pretty much the President just saying they will direct executive branch agencies to abide by the terms of their own treaty as long as it doesn't conflict with existing law. It has no legal standing. So Obama couldn't, say, direct an agency to create a national registry and then use this unratified treaty as a defense in court.

Did the 3d printer guy fight it in court? Any agency can order anybody to do anything, but if challenged in court they must show where they get the authority to enforce the order.
Anyway, I don’t think the case you mention would involve 2A so much as 1A.

Without senate confirmation, the signature is meaningless. No, it's not. Pursuant to the government's 40 years of illegal adherence to the Vienna Convention on the Law of Treaties, administrative agencies will be committed to not do anything to contravene the treaty, even with just a signature. It's "customary international law."
