Your Yard Sale Is Illegal (seriously: feds now regulate those too)
Reason ^ | May 7, 2009, 4:41pm | Katherine Mangu-Ward

Thinking of having a yard sale this weekend? Before you do, be sure to consult CSPC Publication #254 [PDF].

This handy 28-pager from the Consumer Product Safety Commission (CPSC) reminds the American people that, thanks to the Consumer Product Safety Improvement Act, the government is totally in charge of your yard sale:

This handbook will help sellers of used products identify types of potentially hazardous products that could harm children or others. CPSC’s laws and regulations apply to anyone who sells or distributes consumer products. This includes thrift stores, consignment stores, charities, and individuals holding yard sales and flea markets.

Selling old kids books, anything with metal, paint, or plastic that a kid might use, old clothes or shoes with metal components that a kid might wear? You know, any of the stuff people routinely sell at yard sales? Technically, you could be on the hook for thousands of dollars worth of fines. Obviously, it's unlikely the CPSA goons are going to bust up your yard sale. But putting out a detailed booklet that reserves the right to do so is hardly encouraging about where the implementation of this legislation is heading.

I think a much better choice would be a “Don’t Tread on Me” flag, wouldn’t you???

I mean who would HONESTLY want to display a Nazi Flag (collecting historical items, I can understand that even if I wouldn’t want the same things in my “collection”)? It would imply that you personally were a Neo-nazi, and its meaning would immediately be interpreted as support for Hitler’s planned vision, vs. anything to do with Obama. Besides, All Constitutionalists have already been accused of being Neo-Nazis, and this plan would play into their propaganda...

Besides, how many people would actually STOP at a garage sale displaying a Nazi Flag? I know I wouldn’t and my view of that neighbor — would instantly be completely negative! Bad business idea, and one that might make you an instant social pariah no matter your explanations or intentions, as well! IMHO!

Now, a Gadsden Flag (Don’t Tread on Me), proudly displayed might get the point across — it could even lead to discussion with your “customers” about why it’s being displayed...

“Ignorance of the law is no defense” is what they will claim despite what it says in their little “booklet”.

They’ve already covered that — there was a church in Minnesota I believe that was fined for serving a home-baked pie during a church dinner... The kitchens in those churches must be used for ALL food served, and they are open to inspection and all the laws a regular caterer or restaurant (for instance) may be.

Wish I could remember more so I could google it and give you a link to the story... It was quite sad, really...

Forget a civilian lawyer — the BATF already does “stings” like that with gun shop owners. It will be “undercover” federal agents buying the “suspicious” items.

Oh, and darn it all, stop publishing ideas they can use against us! LOL JUST KIDDING! :)

Prayers up - God bless you and yours.

Like I said previously, I'm not a yard sale person. But why should I make demands on what other people enjoy?

Our dog barks, which no doubt irritates my neighbors. But she lets strangers know we are protected. In this day and age, that's not a bad idea.

The more I have thought of this entire Obama administration, the more I believe they are insane. I mean that sincerely.

The biggest yard sale in the US or something is coming up. I wonder if we could make any conservative converts by handing out copies of the handbook to sellers?

My daughter told me to open the garage door and tell people to go at it!

So... the new restrictions have been put into place, then?

Don’t they want us to recycle? Because that’s what a yard sale is - recycling. We’re just being environmentally friendly, and now they want to punish us for it.

These new regulations are just one more way our overstepping Federal Government has made being self-sufficient that much harder.

America -- a great idea, didn't last.

What if I don’t have a yard sale, but a garage sale? I’m then off the hook! Nothing for sale will not be displayed on my lawn. LOL

Can you imagine FBI agents sniffing around every yard sale in the Nation?

No, but I can imagine that selective enforcement of this law could be used to harass the "politically incorrect" when your Lefty neighbor makes a phone call.

“Can you imagine FBI agents sniffing around every yard sale in the Nation?”

No, but I can imagine millions of Acorn thugs and 0b0z0 Youth Thugs monitoring yard sales and any non profit sale of donated personal property. They would love to put the Salvation Army and most churches out of business.

We missed the biggie ... ah, shoot ...

Our next-door neighbors (corner home) stay gone for weeks at a time. They "shop" for stuff to sell? I've never asked, but the lady did tell me that people buy absolute junk. It amazes her ... LOL!

On April 25th, I watched from my dining room table, as one person after another picked up what looked to be a round, wooden cutting board - still had its protective cover and label - and set it back down.

Finally, when there was almost nothing left, a woman bought it.

Good thing 'cause I was about ready to go over and buy it, myself, just to stop that parade.
