Justice, Supremes confirm getting eligibility challenge

The U.S. Supreme Court and the U.S. Justice Department today confirmed that documentation challenging Barack Obama's eligibility to be president has arrived and soon will be evaluated.

Confirmation came from DefendOurFreedoms.us, the foundation through which California attorney Orly Taitz has been working on a number of cases that raise questions over Obama's birth location, and therefore his qualifications to be president under the Constitution's demand that the office be occupied only by a "natural born" citizen.

According to the blog , Taitz was informed by Karen Thornton of the Department of Justice that all of the case documents and filings have arrived and have been forwarded to the Office of Solicitor General Elena Kagan, including three dossiers and the Quo Warranto case.

"Coincidently, after Dr. Taitz called me with that update, she received another call from Officer Giaccino at the Supreme Court," the posting said. "Officer Giaccino stated both pleadings have been received and being analyzed now."

The report from the Supreme Court also said the documents that Taitz hand-delivered to Chief Justice John Roberts at his appearance at the University of Idaho a little over a week ago also were at the Supreme Court.

WND has reported on dozens of legal challenges to Obama's status as a "natural born citizen." The Constitution, Article 2, Section 1, states, "No Person except a natural born Citizen, or a Citizen of the United States, at the time of the Adoption of this Constitution, shall be eligible to the Office of President."

If 0bama is publically proved to be ineligible, a lot of Dems will go down since they covered for him. From what I’ve read, all his appointments, bills he signed and so on would most likely be out the door too. And the Dem party would be very, very tainted. Crippled, really.

They weren’t thrown out. A clerk didn’t forward them as he was supposed to and posted on the SCOTUS website that he did.

For some reason my computer is having a hard time with that link - for many minutes the little green bar at the bottom is hovering in the middle and it says “three items remaining”. I have DSL so it’s not that... Is there something else wrong?

Sounds as the the SCOTUS Justices need to investigate their own clerks. Depending on an 0bama appointee will do nothing. An “investigation” will (or won’t!) be held and the clerk/s will all be found blameless.

If this heats up (as it seems to be doing) Ingraham can start talking about it - she clerked for Thomas.

They are on a list for conference, and then they are on a list stating that they won’t be heard - no explanations given. How in the heck can we be sure that ANY of the cases that appear on that second list were even DISCUSSED?

They probably weren't. While no one except the justices are allowed into the conferences--not even the clerks--we really don't know what happens, but we have a pretty good idea based on some of the procedures that are known.

7 of the 9 justices participate in a cert pool, which means that all the cases that come in are divided up amongst the 7 justices' clerks, and the clerks write memos on the cases they have been assigned, which include a recommendation as to whether cert should be granted or denied. The clerks for the remaining two justices brief every case and write a memo for each case.

Given this, it's very likely that the justices will go into the conference with a list of some large number of cases and the CJ will say something like: "anyone interested in any of these cases?" and if someone says yes, it's discussed and a vote is taken. If not, the case is flushed.

I can only imagine what they might uncover.

Nothing.

I await for the various talk show hosts and conservative writers to start talking/writing about this. The ones that have already pooh-poohed it are not eligible...most have remained silent or just mentioned in passing without going in depth. Some, like Medved (I would never call him conservative anyway) was very nasty about it.

You haven’t read the various information posted that at least two of the Justices had never been presented by anyone with at least Taitz’ cases? They never saw them at all? There is quite apparently subtrefuge going on. Are you not aware of this?

I understand exactly what you’re saying... I know that these meetings are private, that the clerks go through the cases, etc... HOWEVER, I don’t think you understood my point.

Nothing in those procedures would prevent what I’m speaking of. The CLERKS are the ones who READ the cases, and then make notes and refer them to the judges. In more than one instance it has been alleged that case files didn’t even MAKE IT to the judge’s desk to be ASSIGNED to a clerk to look over.

Surely, the clerks who review the cases at the behest of their assigned judge can’t make comments if parts, or even the WHOLE of the file is MISSING, or the list containing the case is NEVER PRINTED AND GIVEN TO THE JUDGES!?

That’s obviously not the only allegation against a specific clerk here, or even a group of clerks perhaps... but, again, nothing I can see in your post would rule out the above situation...

I keep vacillating between trying to educate others about what’s happening in the government, and trying to stop it somehow, and simply saying there’s nothing I can do to stop it, and instead spending my time trying to educate others about God...

For now, I’ll still do a little bit of both, I guess...

I have come to the conclusion that a split in the country is inevitable.

The two sides are irreconcilable (see tagline).

There is no way you can get along with people who want to control every part of your life because they think they know better.

It appears as though this issue has become a safety valve, in case Caeserhope&change oversteps, which even our overseas friends see him doing.

Well, it’s good to know where someone is coming from in any event, so thank you LJ. I won’t bother trying to convince someone who is already convinced, that’s for sure! :)
