Not that John's analysis isn't great, but some of this is so obvious, I'm stunned that Justice Kennedy can get this wrong. He must have the IQ of a squash.

The ruling should have been a citation of the section of Article III granting the authority for Jurisdiction to Congress; the law removing Jurisdiction on the particular matter from the courts; a citation that the matter in question fell within the description in the law; and a ruling that the court has no Jurisdiction, case dismissed.

Maybe half a page.

Bash Specter all you want, but he has been super in getting the judges through.

So far, but the next one is different. Teh next Supreme Court nominee potentially tips the balance to 5-4 our way. The Specter will never allow that, RINO that he is. Arlen has always been a Dimmycrap at heart.

Thank you for putting it so clearly and succincntly. Oh, the politicians and judges will bow to public pressure and will concoct "a way" or "a procedure" to ensure that these terrorists are safely dealt with, but they'll do it in a manner that seriously damages the Constitution. That is their ultimate goal. These other rationalizations are simply whistling past the graveyard.

Come on. This is like the Second Coming prophecies: "well, it didn't happen the last 200 times I predicted it, but NEXT time . . . ."

Specter has also pushed through all the appellate justices. He has been marvelous. If you're going to criticize, you have to give credit, too.

It's like DeWine. As much as I hate the guy, he has been one of the most consistent pro-life votes ever in the Senate.

It takes millions of stones, well-dressed and well-placed, to build a nation.
