Day 4: Hearing Resumes
This morning, Senators will question Judge Alito during a third round. They will then go into a closed session, to review the FBI background investigation on the Supreme Court nominee. Outside witnesses may be called to testify this afternoon, as well as the American Bar Association, to discuss its recommendations.

When Alito was saying "first, you must look to statutory interpetation" I think he was implying, "Hey, don't assume this violates FISA."
If its true that the eavesdropping was done to overseas targets, then I think it doesn't violate FISA, and the Court doesn't have to define the President's wartime powers, which I'm sure it would hate to do.

I guess the IQ of the majority of CNN listeners is so low they thought no one would notice such a stupid question. I was glad Ed came back at him -- embarrased him actually -- and I wrote so they knew it didn't go unnoticed by everyone in fly-over land.

I'm not sure whether the good judge is talking Feingold to death to use up the senator's time or whether he really is a detail wonk that he gets so "into" a legal question that he gets immersed and can't stop the bubble machine.
Maybe some of each, LOL.
At any rate, I'm getting a lot of work done this morning while everyone drones on....and on....and on......

Its Ironic that the Democrats would probably consider their own line of questions to Judge Alito during this hearing torture at Gitmo.But, Judge Alito is the enemy. It's a special case. Millions of innocent babies may live if Alito is confirmed. Waterboard Alito immediately. /sarcasm
