The subject isn't brain dead people. It is PVS (and as you know, that diagnosis is contested .. but even if it was not), and the law is different then. As far as I know, the law looks for an Advance Directive from the living patient. THis is different from looking for the advanced directive of a brain dead patient.
So, do you have a cite for the proposition that somebody other than the PATIENT has a legal right to decide, when the PATIENT is in PVS? I understand that state laws may differ on that point. State law in Florida give the power (to decide) to the PATIENT and NOBODY ELSE.
Isn't that the same TESTING used on DRUNKS at POLICE STOPS???????

At any level, this image is one of a very bad brain. But, do go to the link and explore further. I didn't follow this image back to it's original source, but I'm sure it's doable on Google. I have not seen any dispute that this is actually Terri's scan, though.
In the end I don't think it really matters. It's just one more thing to argue about.
Do you know anything about diagnostic radiology? The image you've shown on the left confirms the fact that Terri Schiavo has cerebral cortex. You understand that, right?
Talk about shame... are you saying the parents upon becoming guardians would have instituted a no ressucitate order and deny therapy and then starve her to death?

Ah, but they do review the appellate transcript of testimony on appeal to insure that every element of the holdings of the trial court are supported by some evidence in the record. What they don't do is reweigh it. What they do do is make sure there is some evidence to support every element of the conclusion. Done quite a few of those puppies in my time.

From what I understand they are also cracking down on this now so that if the cops suspect you of driving under the influence you are automatically considered an alcoholic until you can prove otherwise...therapy, AA meetings and the whole nine yards, until such point as you can prove you are not an alcoholic will you get a license back. It's no longer about the commitment to not drink and drive, rather there is movement for no drinking period if you want to drive again.
If you mean that in the techical sense, NEVER.
WHY? Because, the people who make law, or rule on the law, aren't bothered when it affects you and me.
BUT, they will not allow you to use those laws to freely KILL THEM. They will have special protections, interpretations, etc.
