A Charlotte immigrant family is pinning its hopes to remain in the United States on President Barack Obama's recent policy change allowing illegal immigrants who don't pose a threat to public safety to stay.
On Thursday, Arturo Cabriales Gomez, his wife, Abigail, and their three children, Aldair, 14, Adamaris, 13, and Arizbeth, 10, were ordered to leave the country by Nov. 21.
They were among 20 immigrant members of an evangelical church who were ordered removed by a Charlotte immigration judge.
Rob Heroy, an attorney for El Buen Pastor, an evangelical congregation with members in Charlotte, Raleigh and Lumberton, said he will appeal.
Immigration Judge Barry Pettinato denied the members' request to reconsider a motion to throw out their case based on allegations that border agents stopped their vehicle in Louisiana on April 15, 2010, through profiling as they returned from an annual church conference near Houston.
But Pettinato did not have the family or any of the immigrants taken into custody.
At the hearing Thursday, most of the members were dressed in conservative clothing. The women wore veils to cover their hair.
The church group must appeal by Oct. 24, which would allow the members to remain in the country pending a decision from the Board of Immigration Appeals, Heroy said. He said it can take as long as two years for the board to make a decision.
Arturo Cabriales Gomez, whose family is from Mexico, said he's optimistic that the additional time will help them seek to have the case closed based on federal guidelines introduced last month.
"Our only hope is that Obama stops the deportation," he said.

It’s time for American taxpayers to sue the hell out of our so called “government” for their failure to enforce our immigration laws. When laws are passed, you don’t just blow them off because you don’t get warm fuzzies when you have to enforce them.

You're way behind time. They've been arriving in their Mexican busses for years. Here, they drive up I-35. One pit stop is on the east frontage road near Buda, TX between San Antonio and Austin where a taco truck parks and feeds them. Another pit stop is a convenience store on the west side of I-35 in Temple, TX so they can pick up snacks, beer and use the potty. Amazing how ICE is never around.

So Barack Obama can reverse or determine, the laws of the Land, made by the US legislature as ordained by the Constitution?
And this is what we get from a totally self serving pusillanimous Congress, Democrat or Republican, afraid to stand up for any national principles whatsoever? Hoping to stay in their privileged positions?
Aren't there RICO laws, and 187 (g), and ICE authorities to deport those who are blatantly cheating on the US taxpayer?
Are we now really that degenerate that we can't determine right from wrong? They are here illegally. They have no respect for the laws of our land or those who pay for it.

Let's get dead serious, shall we? I'm getting damn sick and tired of this BS.
Obama’s order means nothing and was simple Hispandering. I have yet to hear of ONE illegal who has benefited from it. It was just him trying to look good, and a lot of illegals were dumb/desperate enough to fall for it. I get asked each week what this means, and I have people wanting to “get their papers” and they think this means they can do it.
They don’t get it, though. They still have NO LEGAL CLAIM to any LEGAL immigration status in the US. Many of the people who get referred to immigration court have been pulled over and found driving without a license. I do not think it’s justice to let people stay who have obviously shown that they have no regard for our laws. It starts with the illegal crossing. It continues with fake papers, not bothering to get a driver’s license, etc. Ultimately the community overall gets the opinion that they can pick and choose which laws they feel like following.
If they are truly Christians, then they will obey the laws.
I must admit I do not like foreigners. However, any foreigner that makes it to America, LEGALLY, I support 100%.
Most foreign owned business’s I frequent know the English language. They seem happy, well adjusted and are willing to engage in conversation.
I have also learned, through my talking with them, they work long hard a$$ hours, just to make it.
They hate welfare, any handouts, just as I do. The economy sucks right now. We speak about it. They are also quite ticked off at the illegals, who “cut in line”, while they had to work their butts off to achieve what they have.
