The prosecutor in the Kobe Bryant rape case says he has slam-dunk evidence to prove the NBA superstar's guilt, it was revealed on the eve of the hoopster's first court appearance today. Eagle County District Attorney Mark Hurlbert made that strong claim in court papers arguing against making public the police affidavit written to justify Bryant's arrest early last month.

My posts represent my opinion. I have never said Kobe was guilty. I don't care if you agree or not. I don't agree with your posts either. It's a free country. I still say you are completely biased in favor of Kobe, very emotional about the issue and accept only reports that are favorable to Kobe's defense.

It is prejudicing a jury with all this reporting hour after hour.

Of course. That's the point.

One side, especially one that doesn't like its position, begins to leak evidence or "evidence," if you will, in order to taint the jury pool. This is especially true if the leaked "evidence" is stuff that might not be admissible in court. The other side, feeling like the case will be lost before the first hearing if nothing is done, leaks back.

That's all that's been happening since day one. This is actually a classic case of leaking, since it appears that the defense started the leaking (notice that most of the info in the first few days focused on the accuser's mental and sexual past, most of which couldn't be mentioned in court). Defense lawyers don't feel quite as bound by ethics requirements as do prosecutors (since defense attorneys don't have superiors breathing down their necks, nor are they answerable to anyone other than their client, who doesn't really care how he gets off so long as he does), and all they really need to do is sow enough doubt to get their client off. This is a very common and, unfortunately, effective strategy for defense attorneys.

Remember, to these people, it's not about guilt or innocence; it's not about justice or injustice; it's about winning or losing. It's sick, really...

You are so right -- winning is everything to lawyers -- guilt or innocence doesn't seen to matter in a lot of cases. I really detest defense attorneys but recently my opinion of prosecuters isn't too great either.

Personally think the legal professional on both sides of the aisle need cleaned up and they need to quit trying high profile cases in the media with all their face time.

But then I am sick and tired of seeing lawyers on the cable shows discussing cases when they have not seen the evidence but reach a conclusion and even get in fights about it on TV. IOTW, trial attorneys have moved below used car salesman in my book -- right down there next to members of the liberal media and democRATs!

My local radio here in OK is claiming that the DA said those exact words for what it is worth! From the way I read the story, the DA made that claim in the court papers. It is my underline and my quotes in the referenced paragraph.

Of course, but false accusations are still false accusations.

In cases where there are no witnesses, inconclusive physical evidence, and plausible allegations of consensual sex, how do you propose to determine which side is telling the truth. In those instances the case comes down to a credibility battle and the relevant history of both parties that bears on their credibility will be brought into play. There is no other way.
