Afederal judge on Thursday disqualified the U.S. Attorney for the Northern District of New York and blocked the subpoenas his office issued against New York Attorney General Letitia James.
John Sarcone III, the judge ruled, was illegally serving in the post, Politico reported. The decision from the Obama-appointed U.S. District Judge Lorna Schofield marked the latest such opinion over controversial Trump appointees to U.S. Attorney positions.
“When the Executive branch of government skirts restraints put in place by Congress and then uses that power to subject political adversaries to criminal investigations... it acts without lawful authority," Schofield wrote.
Sarcone had pursued subpoenas against James, who famously brought a civil fraud case against President Donald Trump during the 2024 election cycle.
Other Trump-appointed U.S. attorneys have faced legal disqualification, including Alina Habba and Lindsey Halligan.

Useless article. On what basis is this ‘judge’ saying the US attorney’s appointment is unqualified?
I’m not a lawyer, but the judge who just took this action is a US District Judge for the Southern District of NY — and what she did was to disqualify the U.S. Attorney for the Northern District of New York.
Seems like a power overreach, but what do I know?
Judges believing they understand the presidency better than the president. Most are doing the very thing they accuse the president of. Personal judicial activism cloaked as proper rulings/use of their power.
I’d love for them to have to take an exam about the executive branch’s powers and see how badly they get it wrong.
Since when can a federal judge disqualify an appointed U.S. attorney directed by the President of the United States? Time to send in the U.S. Marshalls to arrest the judge for violating presidential powers.
I think they are reacting to the fact that Congress has not confirmed the appointments. As a result these US attorneys are serving in an “acting” capacity. The judges seem to be saying that acting-attorneys do not have full powers to charge or to compel testimony.
I kept warning people that all of this rampant immigration would end up being detrimental to this nation.
Congress ought to explicitly define a Natural Born Citizen (born in the US to two parents both of whom are US citizens at the time of the child’s birth).
And Congress ought to declare that only NBCs can serve as federal judges or run for federal office.
Because she said so................
Which, if true, means that the civil judicial system is utterly broken and literally non-functioning. She is not allowing there to BE a prosecutor for SDNY.
Which is when it is time to send the cases to military tribunals.
This gal is too stupid to know that she is rendering the entire civil judicial system moot.

Curious, this is happening all over. Has any other president faced challenges to prosecutorial appointments by judges? Any Democrat presidents?
If so, I do not recall them.
We continue trying to fight the left with one arm tied behind our back. We’re gonna continue doing this and 4 years from now we are gonna wonder why we are where we are.
I don’t either, and I think this shows that there is a conspiracy amongst the judges. More checking should be done at what is happening in the back rooms at the American Inns of Courts or whatever it’s called, where Boasberg and a bunch of other leftist obstructionist judges have been with Chief Justice John Roberts.
I think they all better be watching their backs for seditious conspiracy charges at the very least.
That interference should be the focus, and James and the rest should be charged with sedition and treason and put before military tribunals.
Because Federal Judges are KINGS.
But if the Insurrection Act is invoked, could Military Tribunals be part of the way forward?
