If Mike Pence had sent the fraudulent electoral college ballots back to state legislatures for further review on J6

DC_Draino @DC_Draino

If Mike Pence had sent the fraudulent electoral college ballots back to state legislatures for further review on J6, he would not only go down in history as a courageous American Patriot, but he would also be the heir apparent to the MAGA movement and would be #1 in GOP primary polling right now for 2024

Instead he backstabbed 74 million Americans at the moment they needed him most

He outed himself as a snake oil bait and switcher on March 31, 2002, when he lowered “two weeks to stop the spread” sign and hoisted “thirty days to flatten the curve”.

Point being he has to accept what the states provided him as acceptable.

That is incorrect. You may have overlooked the word "solely".

With regard to the provision you cite: "The President of the Senate shall have no power to solely determine, accept, reject, or otherwise adjudicate or resolve disputes..."(etc.)

What you do not mention is that Pence had the authority to recognize correct and formal written objections from members of congress that addressed the votes of electors. It is my understanding he held such objections.

There was on Jan6 substantial credible evidence of election corruption. Pense, as a the second highest leader of the R party should have made an effort to see the R members of Congress had an opportunity to confront the various states with that evidence. That, after all, is what the Session is about. It appears, however, that he sat on his hands.

And, coincidentally, it was probably why Pelosi appears to have been anxious to see chaos.

The State Legislatures and Congress control the Electoral Process.

Not a single State Legislature voted to recall any ballots.
Not a single State Legislature voted to investigate any ballots.
Not a single State Legislature said any ballots were fraudulent.

Per the Constitution, the U.S. Congress has the power to reject fraudulent ballots. Congress rejected no ballots.

The U.S. Constitution gives the VP zero power to reject Electoral Ballots.

If you believe the VP has the power to reject Electoral Ballots, please cut and paste that part of the Constitution that says the VP gets to pick and choose which Electoral Ballots to accept.

And if anyone believes the VP gets to pick and choose which ballots to accept or reject, you should be real happy when Heels Up Harris starts throwing out Trump ballots in Jan. 2024 .

And none objected.

Irrelevant.

Are you claiming that the President of the Senate can order State Legislatures into session, and can command their agendas?

No, but nice straw man. The point is that the VP as constitutional administrator of the electoral vote count can reject obvious fraud, just as the motor vehicle clerk can reject a fake birth certificate from a 14 year old who applied for a driver's license. The 2022 law confirms that Pence as VPOTUS had that power, but declined to exercise it.

That is 100% false. There is nothing in the U.S. Constitution or in Federal law that says any such thing.

That’s just a photo op.

Oh you poor delusional soul...

Donald Trump in 2002 said in an interview:
“I’ve known Jeff for fifteen years. Terrific guy. He’s a lot of fun to be with. It is even said that he likes beautiful women as much as I do, and many of them are on the younger side."

I post more photos of Trump with his good friends Epstein and Maxwell. Unfortunately only rarely does Donald Trump pick competent and honest men to associate with like Ben Carson and Mike Pence.

History proves you wrong. Thomas Jefferson and Richard Nixon both did as VP what Pence refused to do. Changing the law in 2022 does not prove that Pence couldn't do this in 2021, and that law is open to constitutional challenge, or declaration by the VP that it infringes on his executive power. Had Pence refused to accept the obviously fraudulent returns, then Biden and the Dems would have needed to sue him in federal court and prove their "standing", rather than the shoe being on the other foot. Since Pence was spineless, that couldn't happen. Pence held the key to stopping the fraud and the 2020 Big Steal. Judas Pence betrayed us all.

A fellow we know as Mike Pence,
turned out to be really quite dense.
When the “vote count” was read,
he should have just said,
‘Hell, that don’t make ANY sense.”

Feel free to share!

All you had to do was watch his stone face, with just a glimmer of derision, when Trump was speaking and Mr. Thirty Pence was on the stage with him. And “Mother’s” face was even worse.

They always hated Trump.

“Pence ended up being ANOTHER bad choice by Trump.”

That’s true. Then you have to ask yourself if Pence really WAAS PDJT’s choice. There are so many stories out there about Presidents being told who they had to choose for VP. For instance, Reagan didn’t want 41, but it was forced on him.

Thomas Jefferson is not relevant to this discussion, as the 12th Amendment was adopted to change the process that had been in place before.

And the Nixon example isn’t relevant, either. He never rejected “fraudulent” electoral votes. The 1960 election had a unique circumstance where Hawaii submitted multiple (actually three) sets of certified electoral votes to Congress, so Congress obviously had a role in helping determine which of the disputed (not fraudulent) slates of electors was the legitimate one.

Had Pence refused to accept the obviously fraudulent returns, then Biden and the Dems would have needed to sue him in federal court and prove their "standing", rather than the shoe being on the other foot.

No, they wouldn’t. His refusal to carry out a duty that is explicitly described in the U.S. Constitution would have been seen as an effective resignation on his part. The next in line as successor to the VP — Nancy Pelosi, at the time — would have assumed the VP’s responsibility to preside over the joint session of Congress.

Once we got to January 6th of 2021, there was no way a Federal court was going to even hear a case about electors or the duties of Congress to certify the results of the 2020 election.

Could you please cut and paste that part of the Constitution that gives the VP power to reject ballots? I’ve asked folks to do this since Jan. 2021. Not a single person has posted any part of the Constitution that mentions this.

The Constitution says that the VP passes the Electoral Ballots to ‘Tellers’ (counters). The Tellers count the ballots and send back a written report which lists the ballot count and who won the Electoral Vote.

PA had requested that their ballots be returned for further review immediately, when it had become apparent that there was so much cheating.

Maybe other states, too, but I only recall PA.

Pence need to be prosecuted for treason.

The way I understand it is that they assumed the election had been fair. Then, when they realized the truth they wanted time to review.

Nope. Not a single state legislature met and voted to recall or investigate any electoral ballot.
