If Mike Pence had sent the fraudulent electoral college ballots back to state legislatures for further review on J6, he would not only go down in history as a courageous American Patriot, but he would also be the heir apparent to the MAGA movement and would be #1 in GOP primary polling right now for 2024

Instead he backstabbed 74 million Americans at the moment they needed him most

This “case” (which is actually not one) is Constitutional science fiction.

The “election” alleged to be fraudulent has no Constitutional existence. The 50 State Legislatures which appoint 535 Electors (and Congress, which appoints 3) have all adopted the custom of having people voting as the means by which the appointments are normally made, but this creates 51 elections, not one.

Those 51 elections occur at the direction of, and are subservient to, 50 legislatures and Congress. The States unwisely granted Congress 3 Electors by ratifying the XXIII Amendment in 1960, so Congress does have supervisory power OVER THOSE THREE, but not otherwise.

There is only one Presidential election in the Constitution, it takes place in December, there are 538 voters, and in December 2020 Biden got 306 of them and was elected President.

No State Legislature objected that its Electors were not the ones they had appointed. No State Legislature even convened to consider the matter. In the case of Pennsylvania, the Legislature fled to avoid considering the matter.

It has never been alleged that a single one of the 306 votes for Biden/Harris was a forgery, that the Electors who casted them were impersonating someone else, or that the Legislatures had secretly appointed other Electors.

There is zero space for an allegation of fraud in the Constitutional Presidential election of December 14, 2020.

As far as the 51 elections which occurred on November 3, 2020, they may very well have been rife with fraud, but since the appointment power of the 50 State Legislatures (535) and Congress (3) is plenary, that’s a problem for those legislatures to deal with should they choose to do so.

Suppose Pence had done this (and not been overruled by a motion from the floor).

Why would the Legislatures, which had sole power over the process of appointing Electors, and which, up to that time, had not objected - no, had refused to convene to even DISCUSS it - why would they THEN have acted differently?

DC_Draino doesn’t hold back and hits the nail on the head. Yep,is all Pence had to do, but no, he had to side with the deep state and coup plotters. He became a modern day Benedict Arnold. History will forever remember him that way.>>> Sorry but no. You don’t wait until jan 6. You do the job long before starting Nov 4. That is what is missing in the conversation. All the the lobbying and work needed to get get done prior to jan 6. That is the whole point. You do no wait for this crap. You lobby the most vulnerable and get the legislatures to send alternates. On Jan 6 it is Pence’s job and congresses job to arbitrate what is what. It has to be done prior to the deadline.

The Swamp has an almost irresistible corruptive effect on even the most noble and well-meaning we send there. It has become so ingrained that those who DO retain their souls go back to private endeavors after one or two stints.

So yes, term limits where a person can return, if their constituents wish, after a suitable period being out. I also advocate a short camp each year where the reps have to coexist and cooperate with each other despite ideological differences, not unlike the Boy’s and Girl’s State programs for young people.

Go a step further and televise that so the people can see it instead of the useless shows marketed as reality. This would reconnect citizens with civics and interest in who’s representing them.

The VP of the United States has no business sending anything back to the states “for further review” when everything had been sent according to the letter of the law.

It’s like putting a check in the mail to pay your electric bill, and having the power company send it back to you just to make sure you really wanted to pay that amount.

New House speaker Mike Johnson seems MAGA (kinda) but in his first speech as speaker he announced he was going to address the $34 trillion national debt by appointing a “bi-partisan commission” to work on it. Which translated from DeeCeeSpeak means none of them are gonna do CRAP! I don’t even know what the national debt means, other than a BIG number. It’s clear that no politician in Cesspool DeeCee uniparty cares a rat’s ass about it, other than talk all scary and stuff.

The section that you cite was an amendment to the electoral Count Act of 1877, and this revision occurred in DECEMBER of 2022, almost 2 years after the events of January 6, ostensibly to clarify what heretofore had not been clarified, according to many constitutional scholars and attorneys. Apparently this was supposed to make certain that which was not universally agreed to be so.

It is possible that this amendment, if constitutionally challenged at some future date, may not hold up to scrutiny by the SCOTUS. The constitution does not declare that the president of the senate’s role is merely ministerial, as no other duty in the constitution is deemed to be so.

Point being he has to accept what the states provided him as acceptable. It’s the STATES responsibility to make sure the electors and results are correct.>>. and if they are not he will need to arbitrate the result. and thank you clarifying this crap that many people have about the job on the 6th. the job had to be done with the legislatures long before the 6th. The sixth is the deadline to get the job done.

There are some FReepers who argue that Pence had no Constitutional authority but to accept those electors. I disagree.

But the real kicker is that Pence WANTED to backstab Trump. He could have stayed home that day. He could have legally refused to accept or deny. Leahy would have been next in line and could have done what Pence did.

But again I say - Pence WANTED to eff over 74 million Americans.

That is not what the founders wanted. They did things for reasons, not ceremonies.That was the last safeguard for the rule of law to prevail. It was ignored and look what has happened.

What I don’t understand about DC_Drano’s statement is that just a few days earlier, all the 50 state legislatures had ratified the electoral ballots. If Pence had sent the electoral college ballots back to state legislatures for further review, wouldn’t they have been simply returned since they were already ratified? Why does he think the legislatures would have done anything different after January 6 vs what they did just a few days earlier?

The constitution requires that the presidential electors be chosen as directed by the state legislatures. No legislature certified that that happened. The certifications came from state executive branch officials, e.g. the governor. So, the play was for the VP, as the administrator of the election to declare that he didn't agree that the certifications were correct and direct the legislatures to confirm the certifications. The legislatures could have done that, but then they are accountable to their voters for that decision. It also may have required a special session of the legislature in some states. Because Pence didn't exercise any such administrative power, we will never know what the legislatures would have done with that decision.

The outcome you stated might have played out but that does not excuse Pence for giving up and not even trying. Had he tried, millions of Americans (besides just the ill-fated J6ers) would have rallied.

Instead, Judas Pence decided to betray Trump and all those who voted for him. Pence decided to cast his lot with the Deep State and go along with the election steal. Pence needs to live with that infamy.

I'm glad Pence decided to run for president and come out of the Beltway because now he realizes the contempt and indifference that America has for him...as evidenced in the photo below, taken from one of his last campaign events.

Riveting...

That was not a choice. The Congress before him reviewed and settled the issue behind closed doors..there is a record of their vote.

Pence's job was to do exactly what he did....read the results of the electoral votes into the record. He had no other role.
