What I don’t understand about DC_Drano’s statement is that just a few days earlier, all the 50 state legislatures had ratified the electoral ballots. If Pence had sent the electoral college ballots back to state legislatures for further review, wouldn’t they have been simply returned since they were already ratified? Why does he think the legislatures would have done anything different after January 6 vs what they did just a few days earlier?
The constitution requires that the presidential electors be chosen as directed by the state legislatures. No legislature certified that that happened. The certifications came from state executive branch officials, e.g. the governor. So, the play was for the VP, as the administrator of the election to declare that he didn't agree that the certifications were correct and direct the legislatures to confirm the certifications. The legislatures could have done that, but then they are accountable to their voters for that decision. It also may have required a special session of the legislature in some states. Because Pence didn't exercise any such administrative power, we will never know what the legislatures would have done with that decision.

Are you claiming that the President of the Senate can order State Legislatures into session, and can command their agendas?
