The mother of the 11-year-old Mississippi boy who was shot in his home by police after calling 911 to report a domestic disturbance is suing the city, the police chief, and the officer accused of firing at her son.
In the lawsuit filed on Tuesday, Aderrien Murry’s mother, Nakala Murry, accuses the Indianola Police Department of gross negligence, use of excessive force, and failing to adequately train and supervise officers, USA Today reported.
The family is seeking $5 million in damages, the outlet said.
Aderrien suffered a collapsed lung, fractured ribs, and a lacerated liver when he was shot in the chest by Officer Greg Capers in the early hours of May 20.
He was released from the hospital last week, and is still recovering at home. In an interview with “Good Morning America” on Tuesday, he said he had his hands up when

I dunno. This was one stupid cop.
What reasoning did he give for shooting the kid?
Makes it sound kind of bad don't you think?
Is there any cam video? Every officer should have his cam on when encountering the public.
Was this a little 70 lb kid or a 170 lb 6 ft figure popping out unexpectedly.
That split second between shoot don't shoot is a bad place to be.
“You have got to be kidding me.”
Had you done the exact same thing as the cop did would you get away with it?
That’s always my litmus test for police misbehavior is whether or not their actions would be illegal if they were mere civilians.
This goes to my three requirements of law enforcement:
1. Uphold and defend the Constitution you swore to uphold and defend.
2. Obey the laws you enforce.
3. Don’t be a dick.
Three simple rules.
How would you feel if a cop shot your kid in the chest for apparently no reason in your own home?
There is probably more to the story, but still...
The picture of the cop shows him wearing a body cam, but the article makes no mention of video
That didn’t take long, did it. And the kid survived.
Granted, some people care for nothing but the buck. So sue at the drop of a hat. On the other hand, an unarmed kid gets shot in the chest. There must be a serious consequence for doing that, a criminal charge or a civil action. Or both.
And as a side note, the article does not explain WHY the cop fired his weapon. Was he startled by a movement in the dark?
Your cop rule #3 encompasses a lot of stuff. So within that rule I’d put:
Leave your ego at home.
Look for ways to deescalate.
Understand that not everyone is your enemy.
This has been alleged:
Police ordered everyone in the house to show themselves with their hands up, he said. When the 11-year-old came out of a bedroom with his hands up, he was met by gunfire, the attorney said.
“He shot him immediately when his hands were up, and he’s coming around the corner,”

I have not reading anything that could possibly justify the shooting.
The guy looks fairly old and probably should have considerable experience.
This says there’s probably body cam footage:

Another thing I have long held is that nothing turns you off to bad cops more than GOOD cops!
Once you experience what responsible law enforcement is like the bad cops make you even angrier because you know there’s no excuse for their arrogance, violence, and corruption.
From the picture I saw taken with his lawyer (so recently) the kid was about 4’ 10” and weighed about 80 pounds.
Gonna be hard to justify that one.
To jumpy for the job?
Bad trigger control?
I don't think he meant to shoot an unarmed innocent kid ...
but if he did .. bring the hammer down.
I would sue every dime I could if a cop shot my 11 y.o. son and nearly killed him. An 11 y.o. who called 911 for help.
I would want that cop criminally charged, the force purged and retrained.
What does the body cam show? The picture of Officer Capers has him wearing a body cam.
As someone who has taken a live fire combat training course FBI rated...
Keeping your adrenaline level under control and pausing is pretty hard to do when you are alone.
It is easy to make a mistake if you are not keeping up on your training.
People behave badly but so do the police.
Which is why to my mantra of "carry always carry" I have added "record always record". And not to the cloud either.
So let's see the unredacted body cam footage.
