WASHINGTON — Supreme Court oral arguments in a key immigration case grew heated Tuesday as Justice Ketanji Brown Jackson, President Biden’s first nominee to the court, rejected the White House’s interpretation of federal law.
Jackson accused Solicitor General Elizabeth Prelogar of having a “conceptual problem” in her understanding of the Administrative Procedure Act, which requires the federal bureaucracy to take certain steps when changing policies.
The case, brought by Texas and Louisiana, challenges Homeland Security Secretary Alejandro Mayorkas’ 2021 memo that said federal agents should review the “totality” of an illegal immigrant’s threat to public safety rather than automatically expel them for certain crimes for which a 1996 law says they “shall” be detained.
The underlying legal dispute is complex and the outcome would bear on only about 60,000 to 80,000 illegal immigrants who are also criminals, Texas Solicitor General Judd Stone acknowledged to justices — but a rebuke of the memo would be a black eye politically for Biden and potentially would allow states more avenues to enforce immigration law, which historically has been done at federal discretion.

Maybe not so liberal after all!................
Follow your heart. Do what you think is best. Screw the law.
I am pleasantly surprised by Jackson.
She’ll move whichever way the wind is blowing
Biden not getting his money’s worth?
That would be a shocking development. Dem appointees going back 50 years are all 100% lockstep reliable pro-fascism. Given that history and her own past rulings I'm deeply skeptical of that possibility. But it would be glorious if it happened.
Oral arguments are one thing. How she votes or writes a decision on a case...is completely another thing. We shall see.
She was probably upset that the Biden Administration didn’t go far enough to stretch that clause for more dictatorial power.
They haven’t a clue who these illegal aliens are and they want the Feddies to review their total criminal record. ROTFL.
Seven watt bulb flickering in there.
Wouldn’t it be a hoot if KBJ turns out to be a fairly strict constitutional constructionist? Probably far too much to hope for, but still . . .
Blacks are directly threatened by illegal immigrants. Look at Compton Calif. what was the hood is now at least 50% Hispanic.
Nationally, Hispanics now have a 3 to 2 advantage over blacks. Depending on your state....Hispanic may have the advantage.
Doubtful she’s conservative, but... I thought she gave a conservative answer when she was asked to define what a woman is. She said she was not a biologist. IOW, she was saying biology determines whether someone is a woman. I never understood why our side didn’t pick up on that.
Or she may occasionally vote with otherwise won or lost causes to make her record seem less extreme.
Thomas is black. Jackson is black. He has an 'in' to school her. :^)
Joe’s gonna sic Corn Pop on her, or at least ask for a do-over.
But seriously, this is not a sign of a fundamental change. Once a Marxist, usually always a Marxist. It’s rare when someone has a true conversion, but I’ll admit it can happen.
Has she figured out what a woman is yet?
