That went very well. Kavanaugh in particular was surprisingly good.

Roberts, in typical fashion, is obviously trying to get Kavanaugh and/or Barrett to sign on to his compromise position. Unlike some other cases where he managed to do that successfully, the problem for him here is that his “moderate” position is not the least bit logically defensible and all of the other justices see that and seem unwilling so far to play that game. He may be successful if the pressure gets to one of those two and they waffle and are willing to just join anything, but at this stage, it’s looking worse for the future of Roe/Casey than I expected based on the cert questions and recent history.

“If we were talking about the second amendment, I know what we’re talking about. Because it’s written, it’s there. What specifically is the right here [to abortion] that we’re talking about?”

God bless Justice Clarence Thomas.

Wow - it is very rare for Justice Thomas to ask questions during oral argument.

“ Kavanaugh seems to be arguing for middle ground.”

Kavanaugh’s middle ground today was more of the true middle ground - the Court removing itself from the issue. It wasn’t the fake middle ground of the Roberts variety, thankfully. I still have my concerns given Kavanaugh’s history, but based on oral arguments alone, he’s much closer to the solid three on this one than many expected.

Agreed on Kavanaugh - caveat that their questions don't telegraph position. Alito is getting kudos too, on the line of inquiry about what is proper action when a past decision is egregiously wrong, e.g., Plessey (separate but equal).

I assume, at some point as they get legs, the newer justices won't care so much what the CJ has to say. More so in the strength in numbers situations. Thomas, it seems, has never strayed from speaking HIS mind clearly. Can't say that for any of the others.

A transcript? That's good. I haven't been able to listen to all of it. The part I listened to, I thought the guy was not as strong on changing the current situation as I would have liked to hear.

Every time I hear that old repetitive statement about a woman has to have a right to determine what she can do with her own body, it makes me aggravated.

As far as I'm concerned the woman already made that choice, and pregnancy was a known possible consequence. So perhaps that woman should learn to make better choices, and not ask an innocent being to pay the consequences.

Yes, Mr Justice Thomas: the 2nd Amendment is there to see. Nobody has to look for it! Speak on Mr Justice. Speak on.

“Sotomayor harping about women’s right to do what they want with their own body. But just fine with jabs wanted or not.”

My LibTard Sister (who has had all the jabs, plus boosters!) and I had that exact ‘conversation’ at Thanksgiving.

Amazingly, it didn’t turn ugly. She just might finally be growing up! (LOL! I crack myself up!)

Totally agree.

And too on the issue of “reliance.” As long as you know the rules going forward, it’s okay if the rules change, they often change - see new laws.

To me, simple humanity demands that we give great respect to the divine gift of conception and treat it with utmost care and respect. Does it have consequences? You bet! Always what we want? Not by a long shot.

But ... this is the law, and it strikes its own morality, divorced from the creator (and even divorced from its own writings). Its failures are bound to be spectacular, and those enamored of it, won’t even notice the failure.

All the talking heads on twitter, some with credentials, feel like MS law is going to stand and that Roe might be overturned.

I liked that question. The lib lawyer was forced to admit that the ‘right’ was abortion itself.

Stare Decisis means that past stupid decisions are used as an excuse for future stupid decisions.

Current situation:

Women, as mothers, can prevent their daughters and sons from being killed between conception and birth by not signing an abortion contract.

Equality:

Men, as fathers, should also be able to prevent their daughters and sons from being killed between conception and birth by not signing an abortion contract.
