Hertz customers are attempting to sue the rental car company after being falsely arrested and sometimes jailed for months after the company listed the rental cars they paid for as stolen.
More than 165 people from several states have filed legal complaints against Hertz for 'egregious business malpractices,' according to civil litigation ongoing in U.S. Bankruptcy Court in Wilmington.
The news made national headlines last week bringing forward another hundred claimants, lead attorney Francis Alexander Malofiy told DailyMail.com.
Each customer claims they were falsely arrested for driving a stolen vehicle despite having receipts confirming their rentals.
The furious claimants say that Hertz used an unreliable computer system and filed false police reports which lead to them being falsely arrested and sometimes jailed for months.
While imprisoned under false pretenses some of the claimants suffered heart attacks, panic attacks, seizures, and strokes as some lost custody of their children or lost their homes, Malofiy said.
Hertz filed for bankruptcy during the pandemic putting the claims on hold. Bankruptcy court judge Mary Walrath heard arguments on Thursday to decide whether the claims will be heard in court.

These people should be awarded the cars they were falsely accused of stealing, at a minimum.
The company put each of them at risk of being shot by police who would have thought they were arresting a felon.
How exactly, when presented with proper documentation such as a rental contract, could a mistaken arrest be made? Horrific incompetence if the documentation was provided.
uh-oh yesterday I rented a car from hertz. It’s sitting in my driveway... should I get a lawyer?
This...might put a crimp in Hertz’s order for 100,000 Teslas that they didn’t tell Tesla they were buying. I imagine the price of 160+ settlements might cost about the same as, er, 100,000 Teslas.

Hertz declined to do an interview but issued a statement saying that it “cares deeply about our customers, and we successfully provide rental vehicles for tens of millions of travelers each year.
“Unfortunately, in the legal matters being discussed, the attorneys have a track record of making baseless claims that blatantly misrepresent the facts,” the company said. “The vast majority of these cases involve renters who were many weeks or even months overdue returning vehicles and who stopped communicating with us well beyond the scheduled due date. Situations where vehicles are reported to the authorities are very rare and happen only after exhaustive attempts to reach the customer.”
As to pulling back police reports once payment is made or the vehicle is returned, Hertz told The Philadelphia Inquirer last year that the reports were valid when they were filed and that “it’s up to law enforcement to decide what to do with the case.”
In its defense, Hertz also claimed the attorneys representing the claimants “have a track record of making baseless claims that blatantly misrepresent the facts.”
In response to Hertz’ allegations of misrepresentation of facts by the opposing side, claimants’ attorney Francis Alexander Malofiy said it is Hertz “trying to hide” what he calls “a corporate disaster.”
“They’ve been aware of this for years, and instead of doing the right thing and addressing it, they’re trying to sweep this under the rug, even through bankruptcy,” essentially turning legitimate renters into criminals, he said.

I believe the customers. They have documented proof and there’s too many of them.
There’s probably a drop down menu somewhere in their system that requests the car’s status thus:
-Available
-Out of service
-Rented
-Stolen
No, that is EXACTLY how the system works.
A warrant is issued, and the cop hauls your butt in, you are booked, and THEN, MAYBE if the judge is in a good mood, the evidence is investigated.
The best part? Even if you are wholly exonerated, your record shows that you were arrested for auto theft.
The legal system is broken. Because there are too many lawyers. Something like 85% of the entire world’s lawyers practice in America

Me too…at first glance it appear a utility’s customers were suing bc they somehow were delivered power at 100hz. Was wondering how that could be! Lol pays to read slowly.
Filing for Bankruptcy in no way makes them not liable for criminal complaints. And what they did was criminal. But in this day and age the big players never get charged with anything criminal.
My bank put a suspected fraud hold on my credit cards while I was traveling. I tried to rent a car from Hertz at the airport but the card was declined due to that. Even after I unblocked it with my bank and explained the situation to Hertz they still wouldn’t rent to me. That was the last time I tried to rent with them. LOL.
