The Capitol Police officer who fatally shot Ashli Babbitt during the January 6 Capitol riot has been exonerated following an internal investigation, according to reports.
Babbitt, 35, was the only person killed on January 6 when the officer - who hasn't been named - opened fire at a mob of Trump supporters as they stormed through the Rotunda.
The commander of the Capitol Police's Office of Personal Responsibility says 'no further action will be taken in this matter,' according to a memo obtained by NBC News.
In April, the Department of Justice said it wouldn't be filing charges against the officer, so the conclusion of the internal probe ends the official investigation.
Babbitt's family told The Washington Examiner earlier this month that they plan on filing a $10million wrongful death lawsuit, claiming a plainclothes officer didn't issue a verbal command.

Just like every other police investigation I’ve read about.
Well where I live, the Sheriff’s office investigates the city police and vice versa; surprise, no wrongdoing is ever found.
The ONLY legitimate investigation of ANY police shooting would be done by non sworn law officers.
The country’s criminal justice system is a nauseating joke.
According to some, as long as the officer feared for their life, they were justified :-(
Let freedom ring.
Yeah.....it would be great if we were really free.
You watched that film of the murder, if the officer feared for his life he is too timid to be in service. He didn’t warn her, he didn’t shout stop or I’ll shoot, he took his Tim, carefully aimed and shot.
I hope he looks over his shoulder every day forever more. I hope he can’t sleep for fear.
Time not Tim, need new keyboard
He feared for his life?
Disgraceful. What state was she from and who are the congress critters? We need to write to them.
Can you imagine if this was an unarmed black person shot by Capitol police and the government brought no charges and didn’t even reveal the identity of the cop who killed her? The country would be burning, with the full approval of the Dems.
The administration of justice in the USA has nothing to do with justice, and everything to do with political power.
Three big lies.
They were not in the Rotunda.
The "mob" was not storming anywhere they were stopped at closed doors.
The "unnamed officer" did not "open fire" on the "mob" he took one aimed shot at Ashli Babbitt.
Agree totally!
Thus needs to go full-on jury trial.
A fourth lie. No one has determined the political loyalties of the various people standing behind the doors with Ashli Babbitt.
Note, we are firmly planted in reality and the US Constitution. We want a jury trail. Antifa and bLM ... well, not so much.
I am by no means and never have been a Law Enforcement Officer. Still, when a Centurion has a Protectee whom He/She is responsible for the safety of, then a circumstance of being isolated in a area with no outlet for avoidance of a frenzied group, it stands to reason that difficult decisions must be made.
The concept was expressed to me by one whom I trust implicitly. I do not necessarily accept the argument, but it is out there.
Definitely, it is not a career choice that I would ever care to make, and I have never desired to be placed in such a place where my primary orders were to protect someone from unknown perils.
We have a legal system, a two tierd one, but not a justice system.
So once again the cops investigate themselves and find no wrong doing.
They can do anything they want.
What are you going to do about it?
Vote them out of office?
For one thing...he’s black...actually...nuff said.
Yep,probably wasn’t vaccinated,too.
