WASHINGTON (AP) — The Supreme Court is being asked to decide whether it's sex discrimination for the government to require only men to register for the draft when they turn 18.
The question of whether it's unconstitutional to require men but not women to register could be viewed as one with little practical impact. The last time there was a draft was during the Vietnam War, and the military has been all-volunteer since. But the registration requirement is one of the few remaining places where federal law treats men and women differently, and women's groups are among those arguing that allowing it to stand is harmful.
The justices could say as soon as Monday whether they will hear a case involving the Military Selective Service Act, which requires men to register for the draft.
Ria Tabacco Mar, the director of the American Civil Liberties Union’s Women’s Rights Project, who is urging the court to take up the issue, says requiring men to register imposes a “serious burden on men that's not being imposed on women.”
Men who do not register can lose eligibility for student loans and civil service jobs, and failing to register is also a felony punishable by a fine of up to $250,000 and five years in prison. But Tabacco Mar says the male-only requirement does more than that.

I don’t get the notion that “equality” is achieved, by advocates of the oppressed, by demanding … compulsion?
To wit “you’re discriminating against me, I DEMAND you FORCE me to do something I could volunteer for but don’t want to!”
When the country actually institutes the draft, then there will be serious discussion on the matter.

Religion, Sex, race, and sexual orientation, including need for transgender surgery has not prevented people from enlisting. Therefore, it shouldn’t prevent people from being drafted.
That’s how I see it. Equal means equal.
Bullpucky. Everyone should register who is within the age catagory. All genders, all races, citizens and non-citizens including those on work visas. No exemptions for higher education or politician’s git. Everybody does the same basic & AIT. The same. If you are 4F you can still stack ammo crates or Pell potatoes. No conscientious objectors - if you can’t die for your country, die for your God. Two years of national service should be three years do we get some value out of all the training you’ll get. After that you’ll be fit and prepared enough to live some place besides your parents basement. Get a job, contribute, build this country. Only then will you have the right to criticize it.
There was also a time when “joining the military” meant enlisting in a state militia, not signing up for the U.S. Army. I’d say a lot of the honor and duty associated with the military should have disappeared after the Civil War when state militias ceased to exist.
Right — and that’s never going to happen.
Draft registration is stupid. We are NEVER gonna have another draft in this country. Stop wasting everybody’s time and all that government money. End it.
But the real solution is to eliminate that archaic bureaucratic boondoggle altogether. If we ever have to resort to a draft it will be because of an existential threat and there will be plenty of volunteers. And if a draft becomes necessary, simply amend Title I to require all education facilities to turn over their student rosters. Women, or any of the other score of genders, can serve as REMFs freeing up men to head to the pointy end of the spear.
If we ever have to resort to that, be certain that the pregnancy rate will soar. Not necessarily a bad thing since our birthrate is well below what Steyn recommends. One caveat, though. A pregnancy exemption should only be temporary lest an abortion follows closely behind gaining the exemption. IOW, you're only exempt if you carry to term and start raising the child. Otherwise, get back in the pool.
And speaking of chosen genders, why has there been no hue and cry from those bio males competing as females demanding their right to register? Or demanding that they NOT be required to register because they are no longer male?
I think you missed the point. Throughout the feminist movement for equal rights, we just never seemed to hear any demands that women also have equal responsibilities in the USA.
And it’s not a question of whether one believes a draft system should exist. It does exist and if women want equal rights, they should also want equal responsibilities. And there would obviously be some draft deferments for women not available to men.
The feminists avoided that issue because they knew what a volatile issue it would be and supporting that equal responsibility would have turned many against their overall cause.
The notion of “involuntary servitude” was abrogated with the 13th Amendment. I don’t see how a military draft could ever be reconciled with that.

Of course you’re right, Sauron, but there’s more: the right of the government to conscript people in defense of the state is ancient and universal. Besides military service, the common law right of posse comitatus allows the local sheriff to conscript residents to deal with insurrection, natural disasters, etc. I believe it to be correct that there has been conscription by the national and/or state governments in every US conflict up to Vietnam
Well, not really. I don't think either side wants their administration to be in the White House if/when the male only draft is ruled unconstitutional, because then that side would own it.
That goes right in line with a point that Dr. Jordan Peterson has made many times. He says it’s very telling that modern feminists argue “equality” when they talk about a lack of women in government leadership and corporate executive positions, but they never complain that there aren’t enough female bricklayers or prison inmates.
If they wanted true "equality" they would insist that everyone gets assigned a job by some steering body so that women get to work as linemen and steel workers and other dangerous jobs where they can be killed on the job. Right now something like 99% of all workplace deaths happen to men, that's unfair to women, they should have access to that opportunity too. After all, it pays more than their social worker job does.
You’d have to drop Korea from your list for purely legal reasons (Congress never formally declared war there), and I’d make the case that everything after 1900 was at least morally questionable simply because there was really no “national defense” involved in any of those military campaigns.
Well, during the Vietnam War my number was real high which meant I would definitely be drafted. So, I joined the US Navy Reserve and spent 2 years on Active Duty, 2 years meetings and 3 years inactive. So, the DRAFT is definitely something that will impact a young person’s life.
