The Supreme Court on Thursday ruled in favor of an illegal immigrant who was facing deportation, stating that they are entitled to discretionary relief because the government did not follow the rules.
Federal law says that an illegal immigrant in such a situation can avoid deportation at the attorney general's discretion if they have been in the U.S. for at least 10 years. The clock officially stops when they receive "a notice to appear" with information about their hearing. But in cases like plaintiff Agusto Niz-Chavez's, the government sent multiple documents containing different pieces of information. The court's majority ruled that because the law says "a" notice, that means it must be a single document.
"At one level, today’s dispute may seem semantic, focused on a single word, a small one at that," Justice Neil Gorsuch wrote in the court's opinion. "But words are how the law constrains power. In this case, the law’s terms ensure that, when the federal government seeks a procedural advantage against an individual, it will at least supply him with a single and reasonably comprehensive statement of the nature of the proceedings against him."

Gorsuch flip flops between defending a purely statist interest and defending an individual on a technicality. It seems to Gorsuch the technicalities are only important when he thinks they are.

The sainted Justice Thomas was in the majority. Maybe he thinks he should actually read the law and apply judgments. Sometimes you agree with him and sometimes you don’t. Maybe that is called judgment?

The Justices have before done similar things, basically kicking it back to them to fix................
If liberals had “a” logic, they wouldn’t be liberals.
The fact that he is trespassing on US soil illegally, and has likely committed various felonies by falsely claiming Welfare to which he is not entitled, seems to have escaped our esteemed and highly educated judges
That can be fixed by statute.
I finally read a Gorsuch opinion and the guy is out of control. I’ve never seen such bizarre legal writing in a court opinion. I actually can’t believe he was a federal judge, let alone that he got through the vetting process and got on the Supreme Court. And then I do a little googling and see all these people claiming what a brilliant writer he is.
Just what I was thinking. If Thomas voted with the majority it was probably the correct decision.
This “journalist” needs a basic grammar lesson. Story is about a single individual — male, I assume — yet he uses the plural pronoun “they” instead of “he”.
But Texas had no standing.
