The sainted Justice Thomas was in the majority. Maybe he thinks he should actually read the law and apply judgments. Sometimes you agree with him and sometimes you don’t. Maybe that is called judgment?

The Congress wrote the law.

The Justices have before done similar things, basically kicking it back to them to fix................

Just what I was thinking. If Thomas voted with the majority it was probably the correct decision.

Alito was in the minority though.

They are the only two folks on the court whose opinion I would value more than seven Freepers chosen at random.

(And I am under no illusions about having great odds of having 4 of seven be worth listening to).
