Trump Impeachment Lawyer: ‘Stolen’ Election Claims Won’t Be Brought Up During Trial

An attorney for former President Donald Trump said he won’t bring up claims about election fraud while defending the former president during the upcoming impeachment trial.

“There are plenty of questions about how the election was conducted throughout the country, but that’s for a different forum, and I don’t believe that’s important to litigate in the Senate trial because you don’t need it,” attorney Bruce Castor told KYW Newsradio Philadelphia. “President Trump has plenty to win with what he has.”

Castor also pushed back against reports that Trump parted ways with his initial legal team about whether they would advance his claims about election fraud.

“I don’t know where people got that notion that was some sort of litmus test to get to defend the president, because as you saw from the document I filed, which had to be approved by the president personally, there isn’t anything in there about the election being stolen,” Castor said.

Castor and fellow Trump lawyer David Schoen filed a response to House Democratic impeachment managers on Feb. 2, arguing that the impeachment trial is unconstitutional because Trump doesn’t currently hold office. They also argued that Trump has a First Amendment right to express his views about the accuracy of the election results.

Democrats argued that Trump’s speech wasn’t constitutionally protected and said it incited an insurrection at the Capitol on Jan. 6.

“Just because somebody gave a speech and people got excited, it doesn’t mean it’s the speechmaker’s fault—it’s the people who got excited and did what they know is wrong,” Castor said in pushing back against Democrats, referring to Trump’s remarks to a crowd on Jan. 6.

I read an opinion that since this Senate Impeachment trial violates Trump's rights as a Private Citizen, he can bring his case to the SCOTUS.

Bill of Attainder.

And THAT's where all the proofs and evidences regarding election fraud will come out.

I think it’s good advice, too. The lawyers need to address the actual charge, and not muddy their argument.

The fraud that many of us believe took place in the last election has nothing to do with what the President is being charged with in this farce of an ‘impeachment’.

To punish him. And impeached presidents cannot run again for the office. And THAT is primarily what they are afraid of.

F’KING WHIMPS - whose bought them off! No ones ever going to go there again - the biggest damn attempted coup ever and the goods were there to see - I saw the damn numbers dancing like crazy and no one will cover it - talk about it - investigate it - nothing????? Just like the kennedy assassination! They got him out in broad daylight with a gun and they assassinate TRUMP in the middle of the night taking him out with the illegals votes! I HAVE F”KING HAD IT! Now the big techs, media govt and DAVOS is going to steal everything else like they did with the vote and tell us “WE will own nothing and WE will like it”!

We must remember this is not a trial in a court of law. The senators do not have to listen to anything the Trump team has to say. Especially if they start in with election fraud.

If any testimony about election fraud comes up, the senators will close their hearings and hold their vote.


The stolen election was certified in the Senate 93-7. It should be no surprise the perpetrators of that crime do not wish to revisit their criminality at the scene of the crime. The GOP Senate want nothing more than to put the 2020 election far in the rear view mirror. Unfortunately for them million of disenfranchised GOP voters will never forget and never forgive them.

Why would anyone ever think that Trump will get a fair shake from the Senate when he never has with much less controversial legislation? The easiest way for the deep state to get rid of Trump and the stolen election issue is for the Senate to convict him. And the easiest way for the senators to join in against Trump is for his lawyers to bring up the election issue. Remember what Senator Linda said? They just want a reason.

Get in, get out of the snake pit, and take up the stolen election for another time and place.

Steve bannon remarked today that “45 GOP senators already voted that the impeachment was not constitutional. What are they going to do go back on what they already voted on the constitutionality and say oh but now it is?’ I don’t think that will happen.

I have the same view as to the importance of using the opportunity to put the facts before the Court of Public Opinion. The problem remains that the DemocRat Senate, with Leaky Leahy presiding, will not give the President the time to actually make that case and will use every stratagem, excuse, and ruse to limit whatever can be presented in the truncated time President Trump is allowed. There is a real danger that not being able to present the whole case adequately, with all the necessary supporting documentation, affidavits, statistical analyses, etc. will actually backfire. The Democrats will say: “you see, we gave Trump a chance to prove his crazy false story of election fraud and he failed which proves the whole thing was a lie, which in turn proves the impeachment charge that he stirred everyone up with lies.”

In short, the tight control over the proceedings makes it a trap for any case that needs ample time to fully present.

As frustrating as this may be, I harbor the hope that Trump can either: 1. force the issue of giving him enough time for his defense; 2. barring that, stand before the Senate and the world and say: “this trial is a farce and an insult to the American Rule of Law as I have been deprived of the most basic rights of a defendant” in effect casting any result into disrepute; or 3. Find another forum to get the message out. Maybe produce a film about it or maybe hold a series of giant rallies at stadiums with the whole presentation, maybe buy television time (if the scum will allow it) on major networks to make the case.

Trump allowed the election to be stolen. He had all of the power, and support that he needed to head it off at the pass. To stop it before it happened. Not wait until after it happened. Trump had every reason to know the extent of the level of cheating that was going to occur. It was obvious to me(As I posted here many times) and it was obvious to anyone with even half a brain. The democrats were setting up for it every-time they enacted another change that only benefited vote fraud. It was more than obvious what they were up to.

Because of him then most everyone sat back and assumed that he had a handle on the situation. Baring some future miracle then we now know that he was prepared for nothing. He did not play 3D chess. He did not even play 1D chess. He was a complete failure in protecting the election. And he was a 100 Percent failure at draining the swamp.

Not one single person went to jail for corrupting the justice system and using it against a president of the united states(Treason).

Trump did such a horrible job with justice that it even leads me to wonder if he is really a bad guy. And if we are all part of a Long Con. It is possible that Trump only played the part of a good guy for a deceptive reason.

At this point the only thing that could save his reputation with me is if there is some bigger trap here that is yet to be sprung. But then that is basically Q theory if there is.
Almost everything good that he did has already been undone. That means that Trump just opened to the door and let the bad guys march right in to finish us off. He failed in his main stated goal to save the nation. When he did march out the door he called for us to unite with those who have the goal to destroy our nation. The same ones he said that he would never surrender to. So unless he does something to fix that then he will be no hero to me.

No, he’s getting good advice, and he’ll listen to it. He never had any intention of attempting to present evidence of election fraud at the Senate trial.

His legal team made it very clear in multiple venues in November and December that they had no intention of subjecting their evidence to serious scrutiny or cross-examination. I see no reason why they would change their minds now.

For somebody who is supposedly a fighter Trump sure seems to find a reason to run from a fight. He can gum flap about a stolen election at rallies all he wants. That won’t change anything. Eventually, the bill comes due. Pulling his punches with an eye toward the future does no good at all.
