The “liberals” on the Court see little use for the First Amendment when it comes to churches and synagogues - why am I not surprised?
Gorsuch’s concurrence is great. He makes clear he’s ready to smash all this petty tyranny the first chance he gets and he is also ready to destroy the overreading of Jacobsen that the left has latched on to. I think Alito and Barrett are with him.
I’m concerned about Kavanaugh’s concurrence. He’s much closer to Roberts than Gorsuch.
Roberts did say that the restrictions likely violate the First Amendment but that they no longer exist as written so no need for an injunction.
I think we have FOUR (4) solid votes against the COVID tyranny. I’m worried about getting to 5. Kavanaugh isn’t as solid as we need here.

To be fair to Roberts (not that he really deserves it), he did not join the (other) three liberals. He dissented separately on the basis that, he reasons, temporary injunctive relief is not necessary at this time because the plaintiffs are not currently subject to the restrictions they complain of. Unlike the other liberals, he seems to be signaling that he thinks the plaintiffs should ultimately win on the merits.

[The AP Votecast showed Biden beating Trump among Jewish voters by a 68-30 margin. That poll roughly overlapped with a poll commissioned by the Republican Jewish Coalition that showed the breakdown as 60.6 percent for Biden and 30.5% for Trump with 9 percent split between minor party candidates and those who wouldn’t reveal their vote.
Another poll sponsored by the left-wing lobby J Street showed a better result for the Democrats with Biden beating Trump 77% to 21%, but it appears that, unsurprisingly, their sample overcounted progressive voters and undercounted Orthodox Jews. By making this ruling the majority sent a signal nationwide that locking down churches - while leaving stores open - will no longer be allowed.
The majority thought it was important enough to send that message that they ruled even though the specific regulations in NY had already lapsed
What about the Funeral Mass? That should apply for the Catholics and then by extension to Protestants, Jews and all faiths.
