The Trump administration doesn't have the authority to divert Pentagon funds to construct additional barriers on the US-Mexico border, a federal appeals court ruled Friday, days after President Donald Trump's visit to a section of the wall in Arizona. In a 2-1 ruling, the 9th US Circuit Court of Appeals said that the transfer of $2.5 billion circumvented Congress, which holds the authority to appropriate money.

Once congress has allocated the money to the Pentagon for national defense purposes, it would appear that the money has been placed under the direct control of the commander-in-chief. If the CIC chooses to use the funds to defend our southern border by constructing a border fence, then how does a court have more jurisdiction over the funds than the CIC. This decision by the 9th Circus of Appeals is nothing more than a stall and delay tactic. This decision will not prevail.

Actually, he must spend the bucks on what was authorized in the budget.
However, he can reprogram budget to fit the need of the nation and he can do that by submitting a reprogramming justification document/request, and it must be approved by the Senate.
