Once congress has allocated the money to the Pentagon for national defense purposes, it would appear that the money has been placed under the direct control of the commander-in-chief. If the CIC chooses to use the funds to defend our southern border by constructing a border fence, then how does a court have more jurisdiction over the funds than the CIC. This decision by the 9th Circus of Appeals is nothing more than a stall and delay tactic. This decision will not prevail.

Actually, he must spend the bucks on what was authorized in the budget.
However, he can reprogram budget to fit the need of the nation and he can do that by submitting a reprogramming justification document/request, and it must be approved by the Senate.
