In September 2018 a University of Kansas student met with police officers outside Lawrence Memorial Hospital.
She explained to an officer that she had been raped the day before. The details, however, were blurry because she was drunk at the time, she said, according to court documents.
Worried about what reporting a rape could mean for her career, she told officers she did not want to press charges. But she allowed them to look through her phone before going inside for a rape examination.
Lawrence police detectives decided the student was lying and, without telling her, investigated her rather than the alleged rapist, according to motions filed by the womans attorney in Douglas County District Court.
Five months later she was arrested and charged with falsely reporting a felony crime.
According to a 2009 University of Massachusetts study, about two to eight percent of rapes reported are false.
Douglas County District Attorney Charles Branson says this is one of them.
The State believes the evidence shows the Defendant fabricated the rape story to effect the relationship between herself and the victim ... and her ex-boyfriend, Branson said in a statement.
The State believes the evidence presented at the preliminary hearing, including: the testimony of (the victim), (her ex-boyfriend), law enforcement officers, and evidence collected by law enforcement, specifically, text messages from the Defendant to her friend
indicate the sexual encounter
was consensual.

Looks like she was raped to me.
An acolyte of Jussie? Where’s It Works Until it Doesn’t Al?
“Looks like she was raped to me. “
hmm. It wasn’t rape the next day.
Lots of bad, ideologically driven "studies" out there.
Sounds like regret to me. Regret is not rape.
Maybe she shouldn’t drink so much. Maybe that’s the problem.
******
I doubt that the number of false claims is that low.
After an acquaintance threatened to tell everyone she slept with that guy, it SUDDENLY BECAME RAPE.
She wasn’t raped.
ONLY IN THE MOVIES do you remember NOTHING after drinking and then the memories come back.
#### her. She shouldn’t have lied.
Lock her up!
Once a woman decides on her own to behave like a whore, she loses benefits of the doubt she would have otherwise. Doesn’t look like a rape at all and it appears the police were correct.
False rape claimants need to be treated every bit as harshly as actual rapists.
On again, off again sexual relationship. Has limited to no recollection of events. No other supporting evidence. Text messages do not support rape. Some bruising indicated, but cause is unknown.
Even if she was raped, it is hard to see enough evidence to support a conviction of rape.
Frankly, if this was all the information at trail, there is no way I would convict. As others said, regret is not rape.
I’ve seen other estimates ranging from 40% to 60%.
And with the #MeToo witch hunt going on, we probably are undergoing a major spike in false claims.
Agreed.
My wife used to work at a university in the office that handled student infractions from cheating on tests to rape. They almost never had a really credible rape accusation. Most of them were of the “regret” type, as if the women could turn back the clock if they could allege rape. Most of the people my wife worked with were leftist/feminist types, and even they didn’t believe the women.
“Once a woman decides on her own to behave like a whore, she loses benefits of the doubt she would have otherwise.” As sad as this case is, I have to agree with you. Drunk women who place themselves in sexual situations with men have forfeited the argument that they were taken advantage of in the circumstance. My advice to women is this: do not be a drunkard as it is unbecoming and opens the door to abuse.
I kept reading the article.
Looks like she had revenge sex with a friend of her boyfriend.
If she would do that, she would fabricate bruises. And most certainly file false charges.
The headline should say “student lied to cops. Now shes the one charged with a crime.”
Jail her.
Pissed at her ex-boyfriend she takes revenge by filing a false rape report. And why not. She has been emboldened by the likes of Bret Kavanaugh’s accusers. Only, they only had to make their claims to silly congress critters, not the police.
The money quote of this story reads as such:
Even if they decided that she wasnt (telling the truth), even if they believed that wholeheartedly ... there is always a chance youre wrong, Rust-Martin said. And to take this kind of action against someone that there is even a possibility was sexually assaulted is, in my opinion, a horrific misuse of the justice system.
The system clearly became really energized and eager to pursue this person who was lying and yet we do not become that eager and that enthusiastic about catching people who commit more than one sexual assault in our community.
Some how I do not think that Ms. Rust-Martin feels the same over the top, suggestions that because the charged person “MAY, POSSIBLY, MIGHT NOT BE LYING” defense should EVER be afforded to the accused if they are male defendants!!
Let me see if I got this correct:
1. She wants to have a Rape Kit completed and she wants to talk with the police.
2. She tells the police she doesn’t want to press charges because it might affect her career.
3. She joked about the sex with a friend and then says she didn’t want to admit she was raped.
4. Someone threatens to tell others about her having this sex.
5. She then decides it’s rape.
6. She also decides to not allow the Rape Kit to be examined by the police. And then decides not to meet with the police or the hospital but tells the hospital they cannot talk to the police about her Rape Kit results.
I have not met any rape victim who has joked about the sex act afterwards. None. Zero. Zip.
She didn’t realize that the police can indeed do the investigation if they deem needed.
She surely forgot about joking about the sex act being texted to a friend, or I’m thinking she wouldn’t have given the police her phone.
Women/girls like her are the reason rape victims, the real ones, are not believed.
Nail her tushie.
