Some years ago, Dr. Tim Ball wrote that climate scientist Michael Mann “belongs in the state pen, not Penn State.” At issue was Mann’s famous “hockey stick” graph that purported to show a sudden and unprecedented 20th century warming trend. The hockey stick featured prominently in the IPCC’s Third Assessment Report (2001), but has since been shown to be wrong. The question, in my view, is whether it was an innocent mistake or deliberate fraud on Mann’s part. (Mann, I believe, continues to assert the accuracy of his debunked graph.) Mann sued Ball for libel in 2011. Principia Scientific now reports that the court in British Columbia has dismissed Mann’s lawsuit with prejudice, and assessed costs against him.
What happened was that Dr. Ball asserted a truth defense. He argued that the hockey stick was a deliberate fraud, something that could be proved if one had access to the data and calculations, in particular the R2 regression analysis, underlying it. Mann refused to produce these documents. He was ordered to produce them by the court and given a deadline. He still refused to produce them, so the court dismissed his case.
The rules of discovery provide that a litigant must make available to opposing parties documents that reasonably bear on the issues in the case. Here, it is absurd for Mann to sue Ball for libel, and then refuse to produce the documents that would have helped to show whether Ball’s statement about him–he belongs in the state pen–was true or false. The logical inference is that the R2 regression analysis and other materials, if produced, would have supported Ball’s claim that the hockey stick was a deliberate fraud on Mann’s part.

Back in 2001 when climate kooks were telling us we’re all going to die from global warming, a few learned scientist pointed out that according to the available data, the Medieval Warming Period (AD ~900-1200) was warmer than the Current Warming Period.
The Climate kooks looked at the data, and knew this to be true and were befuddled. How could it be warmer 1000 years before the advent of SUV’s and capitalism?
So they went to work “getting rid” of the MWP. Data was “adjusted” and new studies, like Mann’s Hockey stick, were commissioned.
The shaft of the Hockey Stick shot right thru the MWP straight as an arrow...like it never happened. “Smoothed” proxy (tree ring) data averaged over 100 years to flatten it completely.
Then he attached the Blade: actual thermometer readings, not “smoothed” from the past 100 years.
Apples attached to Oranges and voila!
Making money off any scam is sooo easy until people start asking questions.
Michael Mann’s MASSIVE FRaud should garner him some MASSIVE jail time!

My own experience at Penn State is if u say anything against GW you will be ridiculed and be thought of as being ignorant. I believe free thought died at this liberal bastion 20 or 30 years ago.
It’s a damning indictment of Penn State that they’re defending him.

Now we need to list other “scientists” who believed his BS work and supported him.

My kid attended Penn State and wandered into one of Mann’s lectures, not knowing anything about him. Rambling, ill-prepared and totally nonsensical.
I’m sure this case result will get a prominenet mention on CNN, MSNBC and the MSM.

Any prediction about anything that includes the phrase “hockey stick” is a lie; ALWAYS, without fail.
In view of the fact that we only have 11.4 years left, I doubt that Mann v Steyn will ever be resolved! /s
