Supreme Court blocks citizenship question in 2020 census for now

The Supreme Court on Thursday blocked, for now, the Trump administration's plan to include a question on the 2020 census that inquires about a person’s citizenship status.

In other words the law does not mandate any prohibition on any demographic related question, and why any administration includes or excludes a demographic question changes not their ability to do so; but we here at the temple of law don’t like this administration, so even though what they did was legal, we will make trouble for them.

Delay the census. The basic reason is that only citizens and any authorized visitors should be represented in Congress, and by extension, the Electoral College. Providing EC votes to illegal aliens is a way to collude with foreign governments to affect our elections, even if the illegals don’t vote in the election itself.

Let's take a little stroll down Memory Lane regarding the Census Bureau and "meaningful" explanations.

Does anybody remember when President Obama nominated Republican Senator Judd Gregg (R-NH) to be the Secretary of Commerce?

The Senate was 58-41 Democrat, with one vacancy (Franken/Coleman dispute). Suspicious political junkies immediately realized that New Hampshire had a Democrat governor, and nominating Gregg to Commerce would allow the governor to replace him with a Democrat to give the Democrats a 60-seat filibuster-proof majority when Franken is seated.

Gregg demanded assurances from the Governor of New Hampshire that he would be replaced by his chief-of-staff, but we all know how good the word of a Democrat is, especially with control of the Senate at stake.

The lure for Gregg was the census, until Obama misplayed his hand by announcing that he was moving the Census Bureau from its longstanding home at Commerce to now being run directly from the Oval Office. Upon that news, Gregg withdrew his name from consideration and stayed in the Senate.

It's clear that Obama wanted direct control of the mechanics of the census by his desire to take over. Was this a decision that the Supreme Court would have considered to require more explanation?

We’re done. This is a big sign to illegals that’s it’s OK to vote in our elections. When the rightful inhabitants of this country finally get pushed into a corner and are forced to put down their Iphones it’s not going to be pretty.

The president should have summoned Roberts on 1/21/17 and said “I know what Obama knows about you. Make it easy on yourself or hard. Doesn’t matter to me.”

The government doesn’t work for us. Trump can say one thing and the next day some bureaucrat just says ‘no we’re not’.

I think DJT should just IGNORE the SCOTUS and put the question ON the census. It’s such an obviously justifiable question that it’s legitimacy is “self-evident”.

Almost. The fact is there's a law, the Administrative Procedures Act, that says even though an agency may have a right to do something the decision to do so can't be arbitrary and capricious. In other words, they have to state a good reason for making the decision.

The problem here is that Wilbur Ross and Commerce botched the justification to the point that the majority of the justices had to say it was just a pretext.

Commerce gets a do-over but they have to come up with a better justification.
