Per congressional official."
The 40,000 bed limit IS law. The Dems wanted it reduced to 16,500.
Trump has six years left.
Its funded beds not a hard limit.
I've said all along the mistake was saying he could do an EO instead of doing it. It trivialized the emergency when it could wait.
President Trump was in an impossible situation. He never should've signed Paul Ryan's first bloated budget, with no wall.
Right now it looks to me like the Dems caved on lowering the number of detention beds.
Funding is same as last year for detention beds.
I’m sure there will be greater details in the final agreement available tomorrow.
Bloomberg reporting this:
“Regarding the detention beds, a third congressional aide said the deal would actually increase funding for those beds by about 5,000 over last years record levels and said there would be enough flexibility built in to meet Trumps request for 52,000 beds.”
WSJ reporting this:
“The bill would provide funding for about 5,000 more beds than the last spending bill funded but specifies an average daily population that Democrats said would require ICE to reduce the number of beds over the next seven months, aides said. However, the agency could transfer money, as it has been doing, to use more beds.”
Right now it seems that both sides (DEM/REP) are pushing their version of the detention bed issue to the media.
Dems saying they lowered the cap, Reps saying flexibility to increase the bed count.
Trump, don’t sign!

The Rinos offered this same deal
months ago without a cap on beds.
They really do think we’re stupid.
If Trump does agree to this, he won’t
win the emergency declaration angle, as it shows (by his admission), that the
situation is not as grave as he claims.
He needs to stand firm on the 5.7
billion.

Shelby caved because he wants to handcuff Trump and ICE.

Concur; the Democrats voted money for the wall and the President can move money from other areas to fill it out. Build and get reelected.

The rest of the money is got by legal and non-emergency use of existing funds
The treat of emergency EO And / Or closing the border remains in President Trump's back pocket.
Dims, GOPe and other malcontents discombobulated as Impeachment is put aside.
Take the long view
The wall will be built and the bulk of it done before November 2020.
No cap.
Period.
As many “beds” as it takes.
There is only one person in DC who is on the people’s side.

Simple
The fewer beds, the more invading illegal alien insurgents that will have to be let go to blend in with citizens.
