The Senate is expected to vote Tuesday on an amendment that would federally legalize marijuana by allowing states to regulate their own medical and recreational pot markets.
But even one senator can block a vote on the amendment, which would address a longstanding conflict between federal and state law.
Sen. Cory Gardner, D-Colo., is seeking to attach the measure to the First Step Act, a bundle of prison, prisoner re-entry, and sentencing reforms that senators voted 81-12 to advance Monday.

POTUS is NOT for pot legalization. He is FOR states rights period.
Prison industry will oppose legalizing marijuana. Pharmaceutical industry will oppose legalizing marijuana. It wont pass.
While Republicans controlled Congress, they should have used marijuana legalization as a vehicle to pass a broader 10th Amendment restoration act.
All federal laws (not just marijuana laws) based on interstate commerce should be limited to commerce between residents of two or more states, not commerce wholly within one state that may have some theoretical effect on interstate commerce.

The Republicans had two golden years (2017 and 2018) to pa fundamental, direction-changing legislation. Instead they did next to nothing.
As to the commerce clause, it should be not invoked at will, but only when a state specifically asks for help. If two states are perfectly happy with the commerce between them, then the federal government has no business interfering.

Yes, you’re right. It’s not Republicans vs. Democrats. It’s Trump vs. the Deep State.
Like it or not eventually it will be legal and receive a tax stamp on it just like Liquor and Tobacco. If the IRS can tax it then they will as we need to deal with the deficit

Now there’s an important issue!
It is; it will take a lot of the wind out of the sails of Democrat candidates. And, symbolically, it *IS* important, as a really good example of practicing what we preach- Federalism.
I guess, I can think of other “Federalism” issues I would prefer to fight over.
We need SCOTUS to oveturn Wickard, and take an appropriate 2nd amendment case. But of the things Congress could deal with in the immediate sense, this one would take an issue away from the Ds
It should NOT pass. Legalizing pot is just a new way to create an under class for the Democrats plantation.
