Roberts refers judicial misconduct complaints against Kavanaugh to federal appeals court in Colorado

Chief Justice John G. Roberts Jr. on Wednesday referred more than a dozen judicial misconduct complaints filed recently against Brett M. Kavanaugh to a federal appeals court in Colorado.

The 15 complaints, related to statements Kavanaugh made during his Senate confirmation hearings, were initially filed with the federal appeals court in Washington, where Kavanaugh served for the last 12 years before his confirmation Saturday to the Supreme Court.

The allegations center on whether Kavanaugh was dishonest and lacked judicial temperament during his Senate testimony, according to people familiar with the matter.

Last month, a judge on the U.S. Court of Appeals for the D.C. Circuit asked Roberts to refer the complaints to another appeals court for review after determining that they should not be handled by judges who served with Kavanaugh on the D.C. appellate court.

In a letter Wednesday to the U.S. Court of Appeals for the 10th Circuit, Roberts said he selected the court in Colorado to “accept the transfer and to exercise the powers of a judicial council with respect to the identified complaints and any pending or new complaints relating to the same subject matter.”

The Denver-based appeals court is led by Chief Judge Timothy M. Tymkovich, the former solicitor general of Colorado who was nominated to the bench by President George W. Bush. The 10th Circuit handled another recent judicial misconduct case from Washington involving the former chief judge of the District Court.

It is unclear what will come of the review by the 10th Circuit. The judiciary’s rules on misconduct do not apply to Supreme Court justices, and the 10th Circuit could decide to dismiss the complaints as moot now that Kavanaugh has joined the high court.

This is farcical. The US Senate’s vote to CONFIRM Justice Kavanaugh (my how that does sound NICE) is the FINAL verdict on any complaints about his conduct during the confirmation hearings. Under the M_Fing CONSTITUTION!!!!!!!!!!!!!!

Both the DC Circuit and Supreme Court have “appearance of impropriety” concerns about these complaints, because the justices/judges on these courts all know Kavanaugh and have known him for years.

To avoid the appearance of impropriety, Roberts farmed out the complaints to another court. Ethically, he did the right thing. As someone noted above, whether the 10th Circuit can do anything about the complaints is doubtful, as the only remedy against Kavanaugh is impeachment and a trial in the US Senate. The 10th Circuit can’t remove him (for that matter, the Supreme Court can’t expel a member).

“The complaints deal with statements Kavanaugh made during his confirmation hearings. They were filed originally with Kavanaugh’s old court, the U.S. Court of Appeals for the District of Columbia Circuit.

“Roberts took no action on them while Kavanaugh’s nomination was pending. He received the first three of 15 eventual complaints on Sept. 20, a week before Kavanaugh’s angry denial of a sexual assault allegation by Christine Blasey Ford.”

Good. Good optics, good political move. Tie up the filers with time wasting motions and counter filings.

If it takes these boneheads enough time and BAD Press from this stunt that alone may kill it Without keeping it on the front burner as it would be if they go straight to SCOTUS.

And depending on who is funding these idiots, they May go broke before they can appeal it up to SCOTUS.

Guess they are stuck with someone reviewing and dismissing them. I think the point that they are moot is truest. Justice Kavanaugh is no longer a judge. He has been confirmed by the Senate to the Supreme Court. These political shenanigans need to be clearly and transparently dismissed to put an end to the BS. I also figure that the judges and justices will do a bit of circling the wagon to protect one of their own.
