If it’s an executive order, it’s not a law, and therefore, out of the jurisdiction of the judge’s powers. The judge should be brought up on charges of obstruction of the executive branch’s legal rights to impose or repeal an executive order. No executive can function if all or any of its powers are going to be questioned and/or stopped by judges who are overstepping their bounds.

How about the good old “no standing” argument? Does a lowly district judge have the standing to run the Executive Branch? Congress can codify a big, fat “NO”

With courts we speak of jurisdiction, not standing. But your point is correct - the constitution gives the legislature unlimited authority to establish, or restrict, the jurisdiction of the Federal Courts as they wish.

We need something like a 3 strike rule...Overturned 3 times by a higher court and you are removed for incompetence...

The Judges sense a power vaccum in the justice department.
Since Sessions is ‘invisible’ most the time on big issues of the day, the judges are not afraid to kick more sand into his face. They are not afraid to act as though there presently is no Attorney General at all. Most judges have a sky high ego and embrace all opportunities to show their powers and your lack of the same.

I think a case can be made the part of the reason for the judge’s decision was poor preparation and execution by the DOJ. Sessions’ fault!!!

And while you're waiting for the appeal, now would be a good time to remodel the judge's chambers, with the usual government efficiency, of course.

Start with the air conditioning. Rip it out now, to prep for the arrival of the new air conditioning, which for some inexplicable will not arrive until December, just in time for testing.

And then, the heating upgrade cycle will commence...
