Sessions rips federal judge for 'improperly' reinstating DACA, 'eviscerating' executive power

Attorney General Jeff Sessions on Monday unloaded on a federal judge who ordered the administration to reinstate the Obama-era Deferred Action for Childhood Arrivals (DACA) policy last week, saying the ruling was "improper" and vowing to keep up enforcement efforts against illegal immigration "aggressively."

Sessions added that the judge had effectively "eviscerated" the legal authority of the executive branch and Congress, and strongly suggested the administration would appeal the ruling.

The Trump administration announced last year it would end DACA, which was implemented by the Obama administration using executive authority and protects illegal immigrants brought to the U.S. as children from deportation. However, the Republican-controlled Congress has failed to agree to a permanent statutory replacement for the program, despite several legislative attempts.

Federal judges have since barred the administration from ending the program entirely, saying it would be acceptable only to shut down future enrollment in DACA because existing applicants had already relied on it. But the ruling by U.S. District Judge John Bates went a step further by ordering authorities to essentially reinstate DACA in full.

Hizzoner has made his ruling, now let him enforce it.

“Sessions rips federal judge for ‘improperly’ reinstating DACA, ‘eviscerating’ executive power”

Judgie will feel honored and positively reinforced by such “ripping”.

Anything implemented “by executive authority” can be rescinded by executive authority. This appeal better be more than just a suggestion. It needs to be expedited as a constitutional crisis.

Perhaps Sessions should consider thinking about maybe writing a letter of disapproval to be sent out sometime in the future.

We don’t need Sessions to tell us the Trump Administration will NOT follow this judge’s orders.

What is the judge going to do?

SCOTUS had better slap this obscene seizure of power by the federal judge fast. It’s horrible that it’s even needed to be addressed.

DACA was never law. DACA was an Obama Executive Order. President Trump canceled it. A federal judge rules it be reinstated.

Sessions is spot on. The judge is way out of line.

The Pope has no battalions. He prevails on his moral authority. Federal judges are in the same boat, they have authority and respect only when they are guided by the rule of law. Liberal judges have become as partisan as the New York Times and both deserve to be ignored. When the Attorney General decides to ignore their lawless behavior, they become irrelevant. That time has arrived.

DACA was an Obama Executive Memo, not order.

The article implies Sessions is saying the Trump admin is telling the judge to pound sand. About time if true.

Yes, appeal it. But REFUSE to comply in any way while appealing.

The District Judge who issued the Order said there was no “legal” justification to end DACA.
Apparently it’s illegality from the beginning doesn’t matter.
This is another reason that we need immediate confirmation to the Supreme Court and at least one more Trump appointee.
IIRC,the average age of his Judicial appointees is about 49.This is good protection for Americans from lunatic liberals.

Yes. AG should simply state that the judges words have no authority whatsoever on executive actions, on either creating or rescinding OS’s, and that the silly judge needs to study our COTUS.
