Former Florida Gov. Jeb Bush said Tuesday that birthright citizenship is a "constitutional right," casting doubt on fellow 2016 candidate Donald Trump's plan to do away with it.
"That's a constitutional right," Bush told CBS News Chief White House Correspondent Major Garrett during an interview in South Carolina, where he is campaigning. "Mr. Trump can say he's for this because people are frustrated that it's abused. We ought to fix the problem rather than take away rights that are constitutionally endowed."
Speaking to reporters later, he added, "I don't support revoking it."

We clearly need a much more definitive statement on exactly what is meant by a “birthright” citizenship.
Said it before and say it again - Just because a cat has kittens in an oven, doesn’t make them biscuits.
Place of birth means nothing unless taken in context with respect to the parents’ own origin and status.
The 14th Amendment is a little fuzzy at times. While it has been the practice to bestow citizenship to children of illegal aliens, this has never been ruled on by the Supreme Court.
ALL “anchor babies” should remain in limbo until this is reviewed and a definitive ruling made.
But maybe not with this Supreme Court.
Birth tourists and offspring of H1B visa holders should also be denied birthright citizenship.

Bush tried to surrender full and complete operations of a few US ports to the Arabs and he also tried to create a Mexican sovereign territory port in Kansas City in order to accommodate his sought after super highway from Mexico City. He failed at both because Americans said HELL NO. So the establishment put obozo in the WH and told him to ignore our southern border and allow (encourage) a new and continuous invasion from the south. Right now, the establishment has basically said eff U to the American people and they want this clown Jebby to be in the WH just to make sure that the people have no voice in the matter. According to the polls, the American people see their criminal ploy and are saying Hell No again to another traitor in the WH from the Bush family.
Congress has the power to restrict scotus’ jurisdiction in any manner they choose. They could pass a law on this or anything else and include a provision that scotus cannot hear any appeals on it’s constitutionality, and attach criminal penalties if they do. Or they could pass a law requiring scotus to get a majority vote from Congress before they can hear an appeal on the constitutionality of any law.
Many persons even such as the judge on Fox TV do not see or want to run away from the words ‘subject to the jurisdiction thereof’. I believe those words were intentionally and specifically put into the Constitution via the 14th Amendment. A foreigner cannot come into the US for one day to have a child just to make the child a US Citizen and take the child back to somewhere where US citizenship is not intended. The judge is full of graham crackers on this issue/matter and illustrates how the US gets turned into a 3rd world nation. Of course he isn’t the only high level legal expert who would make the US A 3rd world pot.

IMHO, the 14th amendment DOES NOT make any guarantee for “anchor babies.”
It specifically says those born in the US and, subject to the jurisdiction thereof, are citizens. An illegal alien is not an American and should be subject to their own countrys jurisdiction. That is why we should send them all back forthwith...unless they have injured or killed someone, or destroyer or stolen property. Then they should be severely punished and then immediately sent back.
Thats why babies born here should be given first aide...and then immediately deported with their mother.
It can, and should, be interpreted that way.
We just need politicians and then appointed judges who will properly interpret it according to the intent of the founders, and the interest of the United States.
So, in order to end this “anchor baby,” hogwash once and for all, the 14th amendment does not need to be repealed. it just needs to be interpreted properly.
Their take on that would be to declare that SCOTUS-restricting law as unconstitutional.
