Alabama Passes Mandatory E-Verify & Immigration Enforcement Bill
Friday, June 3, 2011, 1:25 PM EDT
An Alabama House and Senate conference committee agreed on a new bill, which both chambers have already passed, that requires the use of E-Verify by all businesses in the state and includes several immigration enforcement provisions. Should Gov. Robert Bentley sign the bill into law, it would become one of the largest state crackdowns on illegal immigration in the country.
The bill requires all businesses, public and private, to begin using E-Verify effective April 1, 2012. Businesses that do not comply face suspension of its business license and loss of employee expensing for state income tax purposes. All state and local businesses must be in compliance by Jan. 1, 2012 or face loss of business license and contract.

My rep supports it, but it’s the Dummycrat districts that won’t.
OK, but as it is, if they are caught they can just move from one job to another, or one state to another. And if e-verify was mandatory everywhere, and the feds punished "sanctuary cities," and they started taking illegal immigration seriously, why couldn't illegals use the matching names to satisfy e-verify? Wouldn't you need biometric IDs?
Per plan.
About “biometric IDs”:
There is a very justifiable concern that Big Brother will use such programs to encroach on our private lives and grab power. Remember when researchers outside the NSA developed encryption algorithms? Big Brother made carrying a laptop with 128 bit encryption outside the USA the crime of “exporting munitions.” AL Gore wanted the Clipper Chip required for providers of US equipment and software. As the Founding fathers knew, governments try to take away freedoms.
So what do you think is the solution for illegal aliens?
When you combine these powers is when things get scary. Add the BIO-ID to the National Animal Identification System and you have ID + Tagging + Tracking. Toss in the mandated GPS in cell phones along with prisoner bracelets and you have ID + Tagging and Tracking + Location.
Are we nuts?
I pray Bentley signs this quickly as well.
Any idea what his stance is on it?
I’m truly amazed that our state legislature had the gonads to do this! I didn’t think it stood a chance.
Now if only they will get tough on abortion.....
Compared to other business regulations, many of which are overburdensome, this is fairly easy. We all want benefits for illegals to stop, and that problem should also be addressed. To see that a businessman hires Americans is the kind of burden to which I don’t object.
Presumably, Alabama's immigration laws will also be hamstrung.
why couldn't illegals use the matching names to satisfy e-verify?
Matching names for stolen SSN's? Mulitiple use for valid SSN's?
Before an employer can create a case in E-Verify, both the employer and employee must complete the Employment Eligibility Verification form (Form I-9). All U.S. employers, regardless of whether they participate in E-Verify must complete Form I-9 no later than 3 business days after the employee begins work for pay. Information about the employee from Form I-9 then serves as the foundation for an E-Verify case, which must be created also no later than 3 business days after the employee begins work for pay.
E-Verify guides the employer through a series of questions, which follow Form I-9, beginning with the employee's citizenship attestation, document type(s), then biographical information including name, date of birth, Social Security number and Alien or I-94 number (if a noncitizen). In some cases, the document number and expiration date are also required.
If E-Verify cannot initially match the information, the employer will be prompted to review and correct the information if necessary. Otherwise, E-Verify will display an initial response within three to five seconds.
First thing Monday morning, Holder will sue them.
Go back to where I belong? I swore an oath to defend the Constitution against all enemies foreign and domestic several times in my life, i.e., service as a naval officer for 8 years including a year in Vietnam which included the Tet offensive and another 8 months off the coast and 28 years as a Foreign Service Officer including postings in Iran during the downfall of the Shah and the rise of Khomeini, in Saudi Arabia during the Gulf War, and in Poland during martial law. I have literally put my life on the line for this country and you are telling me to go back where I belong? How dare you.
Something is getting done to mitigate the costs of this problems in some lucky States.
Will the administration fight this? Of course they will, but does that mean we should not take a stand for what's right for this country? By passing these laws now and by keeping our eye on the sparrow for 2012 to send another wave of bold conservative candidates to congress, we will be in a much stronger position even if Obama gets re-elected. By passing these laws now Alabama has marked their territory. Some illegals will leave just because of the bills passage and for each one that leaves a potential job position is freed up for legal residents. This is going to be an extremely hard fight but this is a step toward fairness to the American people.
The solution is the same as it's always been. STOP illegal aliens from coming to our country. That means securing our borders and enforcing immigration laws. It can be done, but not while democrats and Rhino republicans are in power. The next election is so critical in every aspect of our society and our future as a nation. We need to ensure that only true conservatives get our votes. They need to be vetted and vetted again and forced to clearly state and document their conservative beliefs and stances before they are elected. If they evade or sidestep questions don't vote for them.
The Supreme Court just upheld the 2007 AZ law that mandated businesses to use E-Verify.
How about we put the burden where it belongs! On the F-ing Government!
This represents one of the few enumerated powers of the Constitution. They would rather tell me to wear my seatbelt, which is not an enumerated power than protect the borders. To hell with them!
Things would be different if DHS was interested in solving the problem. Haley vs. Napolitano on E-Verify and Illegal Immigration
There is a photo matching component of E-Verify. Intersesting. I don't think they took my picture when I got my SS card. Where do they get these photos?
You’re right..and they have been shifting about as various states enact laws which affect them...they are remarkably mobile. Many coming North now, not just in adjoinging states. ... and more are fast coming into PA. They will shift states as long as possible to buy time.
I am very much for this, however EV it is a double edged sword in tracking ALL Americans. In time they will have all your information, down to what you eat and drink in one place.
